Had a driver get pulled over in MA and received two violations for the same bulb,
393.9TS - Inoperable turn signal: LEFT
393.55E - No or Defective ABS Malfunction Indicator Lamp for Trailer Manufactured after 03/01/98
Also an IFTA violation, its a Penske Rental so not sure how that works but our IFTA is also current...
392.2FTA - State or International Fuel Tax (IFTA) Violation: Status Cancelled (doubt it...)
Can they give out two violations for the same bulb? what's with the IFTA violation... DataQ is an absolute joke but do you guys think its worth a shot disputing?

your ABS bulb is normally not the same as your turn signal. At least on all of the trailers I've ever pulled. But it if performs two diff functions. two diff violations. Just like speeding can also be reckless driving.

ABS is the tiny orange light that indicates an ABS issue. Likely there is an ABS issue, and someone unplugged the bulb so it's not always on.

The turn signal is of course on the back of the trailer, and is a red bulb.
As for IFTA, you need to call Penske and ask them about it. It could just be a paperwork mess-up. If so, the paperwork can be fixed and a DataQ challenge would likely succeed for that violation. The lights if they were out, are a valid violation and as such will not be removed.Last edited: Mar 14, 2021

I agree whole heartedly, I'm just trying to figure out if the DOT guy is abusing his power by overlapping his findings. I cant believe its legal for these guys to crawl under equipment and write up all these supposed faulty components when most of them cant even change oil... its amazing they are given that much freedom and aren't required to even have some of the more basic ASE certifications like for Suspensions etc.... too many times I've heard the stories of the "chaffed" break hose when it was just a glob of grease covered in dust, and your blessed with another OOS on the CSA...sorry I got side tracked a bit...lolD.Tibbitt Thanks this.

I take the chaffed airline violation as a compliment, it means he couldnt find anything else wrong with ur truck , but boss man said he had to write you up for something.

Your driver is supposed to also inspect that vehicle. Do you want to have to get your drivers basic ASE certification, too?Dave1837 Thanks this.

Sounds like to me your driver had a faulty abs and turn signal. I would get on the IFTA thing. Guessing that's f'd up too. DOT loves you Penske guys. You can question his certification, but your the one who doesn't know the difference between a ABS and a turn signal. Just saying...

you clearly didn't didn't read the post, I wouldn't be posting this if there were two bulbs out....as a matter of fact none were actually out, one would stay on when the key was off, either way the inspection was about one bulb....but thanks for stopping by...Last edited: Mar 15, 2021
