    Turn it around. Go after her for lost wages , mental anguish and such. If people figure out they can get bit trying to hustle in court they will think twice about pulling scams when they are in the wrong to begin with.

    Maybe not. Add up lost time for a O/O. Stress of going under, etc.

    . ............. Trust me i wanted to , the lawer who represented me said i had good cause to... But problem is how many times do i now have to go back to NJ at my expence and lost income.. If i'm the one filing the suite i cant add those cost to it... Trust me she (my lawer) and i hashed it out and we both got the same answer ... not worth it... After paying the lawyer i might have gotten a couple of bucks, but with the added loss and agravation not worth it ... Basicly as much as i would have love to, i couldnt see loseing more money just to prove a point... Lawer did tell me that if the insurance co. decided to recoop their money i could tag on, but problem is ... ok say we won a judgement for all that was lost/spent say 350,000 ( thats actullay pretty close) whats to stop the woman from just filing bankrupcy and never paying? ...... My lawer was extremly smart (and hot in a sarah paylin kindda way) so i took her advice.... She had also said that it was rare for an ins. co. to take it all the way out like they did instead of paying off.... She had also told me that she has to advize them (ins co) all the way through the case if they should bail or not... Was told that if they were not confident in me as a witness and what evidence i collected at the scene, that they would have paid off, but since they did it was kinnda their way of stickin to these abulance chasin lawyers who work pro-bono untill there is a settlement...............GD i wish i culd give a reply with out writin a novel........

    With what he "might" get out of the case AFTER the lawyer it isn't worth it. It's to late.

    The NEW rule now for any truck driver O/O or company is to be the FIRST one to sue! PERIOD! Especially if it's not your fault. You have to remember that to be sue then try to counter sue the one counter suing is the one left holding the bag and looking funny in the eyes of the court!

    If you are involved in an accident, you are taking a ton of pictures, the first ones being out the front windshield before you get out of the truck you should be on the phone with your lawyer starting the paperwork!

    Also remember that you say NOTHING! PERIOD! You do ask if the other driver needs an ambulance and if they are all right but say nothing else to ANYONE! Even the police! You give him the facts and say nothing else. The only one you tell anything to is your lawyer and you tell him everything you can think of! That is the one person you DO NOT with hold information from as he's working for you and can not give anything you tell him to anyone else!

    Just remember as the dust settles you should be taking pictures especially of cars passing you that you know saw what happened so tags are the pictures worth a 1000 words! You'll be surprised what people remember when the lawyers PI contacts them!

    It's a new world out there so be prepared to take advantage of it!

    When your backing your truck...Get Out And Look!!! Don't even believe that you have plenty of room. When your tired you may not want to spend the energy to get out, but that is when you really need too. Your eyes are tired too, and they will decieve you. Some people may help guide you in; GOAL anyway. Spotters are not your best resourse. It's not there driving record. Look for yourself and be sure.

    When driving up North in the winter, keep some fuel suppliment in your tanks at all times. Fuel will jell up with low temperatures in your cross over lines and prevent the saddle tanks from allowing the fuel to rotate from one tank to the other. The fuel pump will continue to pump what the engine does not use into the other tank, but since the crossover lines are blocked the fuel will not circulate back to the other tank. You end up with the pump forcing all the fuel that your tank will not hold, being forced out the breather holes in your fuel cap. In the end you'll be sitting beside the road with one tank completely filled up ... the other tank completely empty ... and the engine dead ... praying for the sun to come up and warm the temperature up enough to to thaw the crossover line. Out of fuel with 150 gallons in your tank .......

    Oh heck that's when you build a fire under the truck to warm things up! Yes we used to do that years ago! Nothing like watching some trucker piling wood onto a smoking camp fire under a tank full of diesel!

    Or get your propane touch out to warn the lines up unless you can find a shop to pull into!

    Hahahaha ... I must say Rollover ... you DO have a way with words. Ya know, the only time this happened to me was when I was a newbie and I couldn't quite figure out what had happened. I had fueled up in Elkton Maryland with about 300 gallons and I just KNEW that that would get me home without any problem. Didn't know anything about carrying a propane torch to warm those lines up with ... and what da heck was fuel suppliment anyway ... guess I was a complete sunbelt newbie. Don't take but a couple of experiences like that to get you to thinking real hard about, "well maybe I don't know as much about this job as I thought I did":druid:
