This is a case of a Polyester Pants man digging his heals in rather than respecting a reasonable request from a worker. I can guarantee you that if Schneider didn't offer me a "tall" version of the TE shirts (required when training), I wouldn't be buying my own and if they "fired" me from training over it then I'd be looking for my pound of flesh. This isn't about feelings, it's about what's fair. How would you feel wearing woman's pants as you thumped the 1,943,234,931 tires on your gas bottle? There is a big difference between what's filed in court and what can be released as a press statement (see Giuliani). I'm interested to read Walmart's response to the suit, but I've lost my free access to both Westlaw and Pacer so I doubt I, or any of us, will be able to follow along with the proceedings. My guess is that there was a "flare" discussion about this individual's uniform.
It's not 'required' required, but it's required. When the employee pushes back, it's no longer 'required' and "we've bent over backwards to accommodate".
I know there's a whole lot more to this story than any of us know. A few years ago Northridge National Laboratory claimed Schneider wrecked a 'super computer' in transit.

All I know about this case is from what I've read in the initial filling. From my experience, providing uniforms appropriate for female body types is not cost prohibitive, and is in fact VERY easy to do with Cintas, who I believe is Walmart's uniform provider. My question is why did the EEOC allow the lawsuit to proceed? Also, what happened to make the plaintiff seek legal redress in the first place?

The pants my company gets are all straight leg. I can’t wear straight leg pants, so I have to get them 3 sizes bigger. I see no reason why this entitled Walmart employee can’t do likewise.
