anybody had trouble with getting a cdl suspended after aneurysm

    HEY everyone I had my CDL downgraded to a class in md. The MVA didn't give me a md law showing me why.I researched all of Fmcsa rules and found 6months on anaerobic aneurysm. My aneurysm was in Sept 14 2021. They told me to come back Sept 2022 to get reinstated. Should FMCSA have the final say on the rules pertaining to this?

    A downgrade is not a suspended CDL. You simply have a regular driver's license now. The law is federal, and all 50 states have adopted the federal CDL laws. The law is 49 CFR 383.73. Downgrades are due to not having a valid DOT physical on file with the DMV. Do you have a current DOT physical? If not, you are limited to intrastate only until you can get one. If the doc denies you one, then you have to do what the doc says, and get another exam. You can also apply for a medical waver from FMCSA.

    I had an aortic aneurysm as well as 99% blockage where it went into the left femoral artery. In 2016 they sliced me open from chest to groin and replaced it with an artificial one. Had to pass a physical yearly for 5 years but other than that DOT didn't seem to care. Same when I had a quadruple bypass in 2010.
