Are we all actually logging in On Duty & Clocking In at the start of the day doing Outbound Dock work? Or just clocking in and THEN going On Duty once the truck starts?

I've been Log exempt the last 2-years, but even when I was on logs w/ TMC...if we were on the terminal property, we weren't "On Duty". We were always off.

As large as XPO is, I can guarantee you they will give you the legal answer. You go on duty when you start working. It doesn't matter if it's the docks, driving the truck, or sweeping the floor.

I think people forget Off- Duty means you are free to do anything you want. If you want to go golfing you can because it's your free time. When unloading at a customer most time or 99% of the time you can't just leave and go golfing, because we are required to be their waiting to get unloaded or loaded. Same thing at terminal I would guess. You not free to leave and do anything you want. If your working you On-Duty. Even if they say just sit around and wait while the look for a load.

TMC is pretty scummy for that. Just like they're brokerage department. If you're not free to do whatever you want, then you're On Duty.

I’m exempt, but for legal purposes you’re “on duty” once you punch in.
