This my friend is right up my alley ..
I'm about 6 whiskeys in and I'm not worried a bit because I work for a fantastic company that would never do that to me. You tell your company that you you are available Monday through Friday from 8 to 5 and your unavailable any other time.

I'm writing this 8 pm on Saturday evening. I'm done working until about 0900 on Monday. I drove my truck to my drop location and walked to the bar restaurant. Get with a good company. Me and my saftey manager love tobtalk about how much we drink lol lol

 

The book says you’re out of service for 24 hrs after your last drink

 

You might want to go look at that book again! Go read 382.207. 4 hours!

 

The only reason to hide it is because nosey d-bags cannot mind their own business and idiot bean counters think you are their property not their employee,
Alcohol is legal in all 50 states, sometimes when I roll in on Saturday morning I pull my whole set up in front of the liquor store and load then 3-4 cases into the reefer to restock the shop because I’m too lazy to grab my pick up and go back into town.

 

Since he used the term out of service he might have been talking about 392.5{c}.

It admittedly a little different as it applies only when getting caught and not general usage, but it does fit with what he said.

 

Still doesn't work. Go back and look at 392.5 in its entirety! Take special note of 392.5 (a) (1)

(a)No driver shall -
(1) Use alcohol, as defined in § 382.107 of this subchapter, or be under the influence of alcohol, within 4 hours before going on duty or operating, or having physical control of, a commercial motor vehicle;

If you start driving BEFORE that 4 hours have expired then get caught THEN you get 24 hours OOS!

 

Just to sum this all up! Per the FMCSA you MUST not go on duty after consuming ANY amount of alcohol for 4 hours. Last I hard for pilots it was 8 hours, giving rise to that phrase 8 hours between the bottle and the throttle. This does NOT mean you can operate a vehicle while legally drunk! If you get caught violating 392.5 they are going to place you OOS for a full 24 hour period and if you are legally drunk then the provisions of 383.51 are gonna kick in. Then most likely you are NOT going to be operating a CMV for a period of time!
