yeah that crappy truck i was driving over the last 3 months, a 900,000 mile 2010 peterbilt with a drop axle and coffin sleeper. The ABS light on that truck dashboard was on almost all the time. If i had refused to drive that truck for that reason alone, the boss man would probably have not given me another truck to drive until he fixed that one, which of course would cause me to lose money. That truck has about 915k miles on by now. I was the one to take it to 900k.

it will also cost you money, when you are shut down at some POS scale house in montana/idaho/washington that put you OOS. and cost you even more money when your boss fires you for to many violations. which will happen eventually when his insurance company pushes you out...

DVIR is the Driver Vehicle Inspection Report. That is the paper the motor carrier enforcement officer (DOT, state police or even a local cop certified to inspect commercial vehicles) gives every driver after an inspection.

SMS is the Safety Management System which is also known as CSA Score. This is the database the US DOT uses tontrack and score the safety performance of every company that operates in the US with a DOT number.

The WSP (or any other state or local policing agency) is who enforces the Federal Motor Carrier Safety Regulations. The US DOT does not typically have their own law enforcement officers on the road or at scales, instead local agencies enforce the rules thru state actions. Some states have multiple agencies that enforce these while other states have special agencies that do nothing but truck and bus enforcement.

In most cases you are required to report any citations within 48 hours to your company. If you are inspected, the carrier is required to sign the inspection report and return it with in 15 days. You dropped the ball here.

Driving fatigued is a big no-no. The professional drivers here will tell you that driving when you are out of hours is nowhere as big a deal as driving when you are tired.

    1) you came here and asked us. 2) this forum has many experienced and knowledgeable drivers who are willing to help out. The administrators are knowledgeable as well as @ZVar . You can over time know who to trust implicitly (hint if @ZVar says another poster is wrong about a regulation, you can take it to the bank)

    Workingman818,

'14 or '15 or '16, I No Longer Have My Trip Histories, I got written up at the West Memphis Scale on NB55.
I WAS Out Of Hours, plus other goodies.
I REPORTED IT To Employer, as REQUIRED.
For 6 Months, ANY Scale House I Entered Requested I Park Out Back and Come On In For a Chat.
After That Period Of Time I Was Still Subject For A Log Inspection.
Sure, I Could Have "Altered My Routes To Avoid The Scales" yet Doing Such Would Have Been More Difficult Than Just Entering Scale Lanes and "Rerouting To Avoid The Inevitable" Is WORSE For Both Drivers AND Employers.

    Solution:
PAY ATTENTION To Future Citations Regardless If They Be From City Kitties, County Mounties, Full Grown Bears, Weigh Station Personnel.

Oh, As To The Peterbilt With 900k+ Miles:
    BIG DEAL.
Newbies Generally Receive Such Well Used Vehicles, Because Usually The Newer Vehicles First Go To The PROVEN Safe and Consistent Drivers.
    Gotta "Pay Your Dues".

Oh And I've Driven Sick A Few Times. One Time From Greensboro, NC To Santa Fe, New Mexico.
Sickness Went Away With Elevation, Go Figure.
As With ANY Other Employment, Sometimes "One Has To Do What One Has To Do!!"

    CHEERS!!

Didn’t the officer who issued this citation tell you that the company has to deal with this?

this is part of their explanation no matter what state your in, they have to tell you that.

CAXPT, Cattleman84 and Bean Jr. Thank this.

So from your perspective it's okay to endanger his business/life so you can make a little extra money?

Also. If you're not willing to learn by reading then just turn in your cdl now and get a job picking up trash on the side of the highway. In a written form you can go over the material as many times as you'd like - both now and in the future.

I see you have your mind made up how to do things, even if you're dead wrong. I won't help you if it's not welcome.
If the other guys want to try to help you I admire their patience. There's some good people here, too bad you don't realize that.
