I would say, he is relatively new driver, so he doesn’t really know the difference. 1099 seems easier to him than W-2. I will tell him to try to switch to bigger companies that pay W-2. It makes more sense.

Just let the IRS know you didn’t receive a 1099 for the $3k - the dept of labor will contact the owner operator- fine him for not issuing the missing 1099 - do a 2 year audit. It’s vindictive- but it will get heads rolling
