Question on Authority vs. Broker Authority

    If I have my own authority, and I have a run to make (not brokered), and I cannot make it for various reasons, (breakdown, illness, etc) can I get someone else to make the run for me or is that brokering the load ??? And would that mean I would need a brokers license ??

    Well it would actually be brokering, but it happens every day.

    Me personally, on 1 load I would do it and not worry about it. As long as it was someone I knew would get the job done. I certainly wouldnt risk my customers load with just anyone.

    Just my 2 cents.

    You can legally outsource a load originally tendered to you with an interline agreement or a trip lease.

    Can you elaborate on these ?? I have never heard of them. Are they forms that can be downloaded ??

    I would for sure let the customer know whats going on !!! Some watch real close who picks their loads up. Could be legal matters involved if the customer is left in the dark.

    Opps trip lease is the simplest way to go. And yes their are online agreements. Cant find one right now or I would post a link for you.

    Its not right but there is a lot of unlicensed brkerong gping on from carriers. Happens all the time.

    This sample trip lease from JJ Keller complies with all CFR 49 regs. It' s a be more elaborate than what I think you need. A single page properly worded rate confirmation would do.

    The important thing to remember is that you must take legal possession of the freight. Your carrier name and address must appear on the Bill of Lading. This is what differentiates a motor carrier from a broker. Admittedly, this is a gray area legally speaking. We have the same problem maybe two or three times a month and have to scramble to cover a load.

    Also, you might want to apply for freight forwarder authority, even if you only occasionally do this. All the legal bases would be covered.

    If i get busy and need help i have had friends do moves for me and i have done it for them. I don't think i would just call anyone to do it but if i know them i do.
