Shoulder Tragedy

Just curios who to sue now? TxDOT, car owner, car insurance company, AAA? If truck parked on the shoulder and something happens with car there is no question. But what if car was parked?

 

It's all on the truck driver. He simply wasn't paying attention.

 

Is there a way to look at this without having to download an app?

 

private passenger vehicles only have to demonstrate reasonable care. Commercial vehicles operated by professional drivers have to demonstrate compliance with "best practices". You can make a sandwich for yourself using a dirty knife, spoiled ingredients. You cannot sell sandwiches to the public until your facilities are inspected by health inspectors and you comply with your city/state business requirements. You can sit your child on the couch in front of a TV for 12 hours but you cannot open a daycare business where all children are "just plopped on the couch" until their parents come and get them.

Private citizens are not expected or held to the same level of scrutiny as businesses held to professional standards.
