Advice from a cop on fighting tickets...

    Sound like a jail house lawyer.Read my statement and I covered alot of what you was gonna request.And in my neck of the woods,Lawyers charge by the hour for traffic.Usually $150.00 an hour.
    And I give Cops a bad name by having a high and mighty opinion??I gave this forum insight into how I...I...I do things,not all officers.I even mentioned that.Not all officers are like me.And further more,if you come in wanting all that inof,Patrol car tires measured and all that other crap,our judges are just gonna realize you are just grabbing and straws and wasting their and my time and sock ya with the highest fine allowed by law.Your High and Mighty and I am smarter than the cops and know how the system is .. in my neck of the woods will just make ur pocket book alot lighter.Thats exactly why I said be nice when you come in.

    Cool,appreciate the bump to your credibility.
    BUT. . . . . . you still say you only cited one which means
    you have actual court room experience dealing with one CDL citation.

    We'll use a violation scale of 5-10 Mph over limit as a reference to "TICKET",nothing can be done with the ticket of doom which is 15 mph over against a CDL.

    I'm no stranger when it comes to traffic court and speaking with JP/Judges
    regarding safe driving awards.I learned a thing or two while sitting in court listening to my hired gun run his head on my behalf.
    After a few more "I saw the pattern" and the light,though dim, came on.

    Some States use the term"Habitual Offender",I got my first HO trophy by age 19,my second by age 22.I should rightfully have two -three more but
    the tickets stopped "sticking" :biggrin_25525: They didn't actually give me trophies
    I just acquired enough citations during those periods to deserve one.

    I can already hear the soapbox's sliding across the floor(s) and the judges are donning their robes :biggrin_2559:
    Where is the court room magic Mr Smokie ? whats it really take to beat
    the revenue agents in a court room?
    I'll take the easiest one away right off which is suggesting/proving doubt or questionability to any part of the supportive testimony used by the officer and the methods used to bring the pending charge to the court. (not the actual legal terms so make it legal if ya like)
    Anyone thats ever sat on a Jury knows how this works,the same process that gives you twenty years for a crime also charges you with traffic offenses.

    Last 2 tickets I got I shook the cops hand and thanked them for being so respectful and courteous.

    Back in '90 I got stopped by one of the worst deputies in Collier County Florida. I was courteous to him and he snapped on me thinking I was being a smart alec. I had heard about him from others and got to meet him one morning on my way to work.

    Is it true that most speeding tickets are written after the 15th of the month?

    They busted THP big wheels telling the troopers their evaluations and promotions depended on the amount of tickets they wrote.

    From what i have seen,no one will ever say they have a quota to go by,did I ever have a quota......yes,I did at one time and did not ever get the numbers the Chief wanted.i also left that department for that reason also.I have also worked for a couple of small towns and when i was hired i was told if yo want to work here,ya gottsa right tickets or get laid off.No set number,but I was young then and would write alot of tickets.
    As far as the month goes,I have spoken to officers that do not "officially"
    have a "quota" but they are required to get a certain number of points for the month.Speeder could be 1 point,drug arrest could be 25 points,DUI could be 15 and so on and so on.I was advised these officers would work pretty hard at the beggining of the month to get in their required points and then they could slack off for the rest of the month.

    As far as myself writing a truck driver in a semi for speeding,i know of only one that i have wrote.he cam blasting through a school zone at highway speed.He had a terrible attitude,so I wrote him.Abut a week later same truck came down the main highway thru towngoing at about 12 miles an hour in the 45 zone with a line of cars behind him.Same driver behind the wheel,he flipped me the bird as he went by,cussing me like a sailor as he climbed down.He got a ticket for impeding the Normal Flow.He promised he would never come through our town again,would avoid our town like the plague.and I never saw him again.LOL

    Thank you gentlemen of the leo's, WOW! Boy did you jump into the Lion's Den. First of all ,I have to say "you are doing a great job". Well I'm barred from the site now, for not being a cop burning member. It started out a discussion on speeding tickets, which some good info finally emmerged. But then it turned into a cross burning over the DUI issue. Which by the the way I am an offender. But it started and got lost over being a Money Making Ordeal. I work local here in Bean Town, and Boy o Boy have I've seen the local's "Wright 'em Up". The MA State DOT will give infractions if deserved, But do not dear drive in Cambridge ,MA they love to get "Writer's Cramp". So please don't feel like your George Custer on an afternoon ride in the Dacotas, please stick it out and inform us that are willing to listen to your professional opinions on real CDL matters. Thanks Again, you little Custers

    Not true, I have beaten them. Twice. 1st time the State Trooper did not show up for court on time. Said he was busy. Judge chewed his #$$ right there in front of 6 people and then had him stand to the side while he void every one of them . Told him if he could not bother to be in court and on time. Then don't bother to write the tickets. 2nd time, The lawyer made a deal with the DA. Had it cut from a 74/65 to a 69/65 dropped the fine down from $100 to $25 and no points. Boy was that State Trooper mad.

    I wouldn't say you beat them.Sounds like in the first instance,the Judge has a problem.The officer showed,but he was late.Remember,most officers do not get the whole day off to go to traffic court.Ain't no telling what that trooper just came off of,and the Judge should of asked and got an explaination.Sounds to me like the judge doesn't like da Police or he doesn't like doing traffic court.
    In your second ticket,your attorney pled down.Pled guilty in return for a lesser fine and no record hit.i mentioned in my earlier response to come in and do exactly that.

    cops don't have quotas any more - they have "contact points..." graffiti is now "urban art..." and full of ##### is "occasional irregularity."

    WOW obviously you didn't read the post that I posted not long after that one because I said on there that yes it could get amended down or that you could get traffic school. I said you wouldn't be able to say it wasn't you it's a point target system meaning the only speed it's getting is yours. As far as beating your first ticket you got lucky the trooper was late. As far as beating the second ticket well YOU DIDN'T!!! Beating the ticket means you walked away paying nothing, with nothing on your record, and no traffic school.
