Swift actually had the ability to trip lease written into thier contract.
The problem is in the implementation. Trip leasing has essentially been replaced by the broker system. Why would a carrier trip lease when they can just broker the load.
This may get interesting

The guy was there for only 8 months ... almost seems like a plant.
Law firms were doing the same thing with ADA. Sending someone in a wheelchair out to businesses, then suing if they didn't have a ramp or handicap bathrooms.TallJoe, larry2903 and Midwest Trucker Thank this. -
Carriers need to get out of the truck rental business once and for all. Truck leasing is one of the biggest scams ever concocted in this industry. The federal government is knocking on the door of a national AB5 law as we speak. So if this is your business model I’d highly recommend you start planning an out. When “not” if Congress takes this up in the near future the practice of truck rental/leasing is going to end abruptly.

This was my immediate thought as well. Guy is sueing them because his business failed. No participation trophies in trucking.TallJoe, Ruthless and bamanation Thank this.

Well said. It's coming, it's just a matter of when.77fib77 and bamanation Thank this.

AB5 will affect every guy leased to a carrier not just the guys doing the truck rental plan. At least California's law does. Who knows what Congress will come up with.TallJoe Thanks this.

I think this was strictly a failed "business". However, the root of the issue is leasing a truck from a carrier and calling yourself a "businessman". You start off a "business" by making a bad business decision.

Businessman? Are you conducting business with shippers? Proposals, agreements, liabilities? Leased to Schneider you haul Schneider freight at the price they tell you. Leased to Schneider is an employee, nothing more. Buying a truck and trailer does not make you a business. Government is cracking down at folks getting exploited thinking they are in control of a interstate trucking business.Old_n_gray and nikmirbre Thank this.

Drive like a boss on the back of Dart trailers says it all.Short Fuse EOD and Opus Thank this.

Pretty much. Companies sell the own your business dream, while fueling their own. I was leased on once. Learned quickly that I was an employee owning a truck and a trailer. Not a bad deal, didn’t have to pay for liabilities or worry about much. But I know what I was and was not. Just like right now I know my business could be wiped out by liabilities in a blink of an eye.
nikmirbre and Old_n_gray Thank this.
