First of all... I realize that I am still a rookie and perhaps that is why I still somtimes drive my 4 wheeler... Like when I am home and need to go to th store, or am just going out... as a rookie I drive my 4 wheeler... and even as I gain experience and years I am going to keep a 4 wheeler to drive now and again...

When I hear about a 4 wheele on the side of the road I am think wow, what if that was me in my 4 wheeler on the side of the road... or one of my loved ones... being a rookie not all my friends drive big rigs... most of my family and friends drive 4 wheelers... what if it was them on the side of the road...

I also think wow.. what if as a truck driver that happened to me... I would be devasted if I killed a mother.. or anyone while driving my truck... I do believe that sometimes accidents can and do happen and the driver was not at fault.. there was nothing they did that caused it and nothing they could of done to avoid it...

However, I also know, that there are drivers who are careless and reckless and their actions or lack of are an issue in the crash... I ran with one such guy at it was scary... He had some close calls and some lucky breaks... I hope he does not have a crash and hurt or kill anyone.... but, it would not be surprizing if he did because of his bad habits, carelessness and recklessness. Once, I got up when he was driving over MT Shasta, it was during a winter storm warning and the heat and defrost in the truck was not working right... He was drinking schnapps to keep warm... I am serious... he had already drank half the bottle... and if think that can't be topped, he pulled over to have me. a rookie drive over Mt Shasta for the first time in a snow storm at night and headed off to the bunk after giving me the bottle of schnapps to keep warm.... Think about it... I saw other trucks on the road going over Mt Shasta... perhaps you were in one of those trucks.... I didn't drink the schnapps... but did drive over the mountain for my first time... and then they closed I-5 as I was making my way... so the roads were bad... and my trainer was drunk and sleeping in the bunk... I was glad they closed the road!!

The truck driver is not always blameless... and I am not going to excuse bad drivers... I feel they should be held accountable!!!

Also, a friend of mine husband is a forensic computer specialist... it is amazing what they can tell from a computer.... they look at the hard drive and go under the skin to the guts of it.... Once, another friend of mine was concerned about he teen age son and some problems she was having... she asked if he would help her out and look at her sons laptop.. He said he would... her son tried everything hide his track... but, it didn't work... things were discovered and she had the truth and evidence... Her son came clean and they got things sorted out....
I am willing to bet they will have a forensic computer specialist look over his laptop and the truth will be there...
Also, I wouldn't be surprized if his own mouth and words aren't at play... People in situations like begin to talk and often say things that their lawyers cringe at and that come back to haunt them at trial....

They will hang you for that mistake. When you kill someone with that truck, there is not going to be any leniancy, you will not get the benefit of doubt. If you fudged your logbook 6 months before your accident, they will use that against you. You have to CYA at all times.

    Let's clear some stuff up.

This car was disabled on the side of the road, she did not pull out.

Here is a google maps view of the stretch of road. I have included this because even though I drive this same stretch of road every single day almost, you all may not.

No curves and as flat as friggin Kansas.
I drove that area twice that day getting ethanol from Medina NY to Buffalo. I got off at the exit just before the accident scene. The weather was not ideal, but was NOT a factor either. Wet roads are no excuse for this and that was all that was going on that day. Wet roads.

I know we all like to back the driver. But please, this guy was WRONG. He is a bad example and deserves what he gets. He needs to be off the road. I know though, people here will argue anything.

Some people are born to be "DUMB #####**". Who in their right mind would travel down the highway texting on phones, watching movies, or anything else that would distract your full 100% focus on the road??? I don't have any sympathy for this idiot, but my heart goes out to this poor ladies FAMILY especially these two young kids...

It's funny how some people are upset about CSA 2010. Those who are upset about it better get their act together or they will be out of a job plain and simple. Some of y'all say the good driver's are affected too. If they were so good they wouldn't have to worry about it if they were doing their jobs in the first place.

the article said all of the other cars "avoided" her car while it was disabled.. you dont "avoid" a car that's disabled on the side of the road, you cautiously drive by it. switch lanes if you can.. so either it was still in a travel lane which is why everyone had to avoid it and why he smashed into the back of it, or he actually left his travel lane and went onto the shoulder to hit it.. i didn't see the google map of where it took place so i'm not gonna speculate on location.. in that case the porn or the hours wouldn't even be needed.. they could just hit him with failure to maintain control of his vehicle and the manslaughter charge would be enough.. the porn like everyone said is just hype.. not many would be in an uproar if it said "Trucker Smashes into car Kills mother of two while adjusting GPS mount on dash" people always talk about texting with cell phones while driving.. removing attention from the road, not being 100%.. my wife has a tomtom and i hate that thing with everything i have.. it beeps and tells me, "right turn ahead" i scan out the windshield and i see four streets and seven driveways.. now i have to look over at Tom to see his map and exactly where the arrow is.. the what if and but game has to be played.. if it's never played, then alot of innocent people would be hung out to dry.. i'm not saying he's innocent.. i just dont want him to be cut short all because people jump to conclusions.. i mean it was over a month ago, and the article was updated, and it still doesn't have any statements from the driver.. doesn't even say anything about the lil black box in the truck.. and i know they pull those when there's a fatal accident.
