Joy, that poor driver is boned. Even if he had a blown engine with a hole the size of the U.S debt balloon in it, triangles out. Perfect logs and ever T crossed and ever i dotted he is screwed. It won't matter. The driver will be found negligent regardless.
The shoulder is not for parking. It's emergency only. The trial lawyers, with help from the lawmakers in DC, have very narrowly defined "Emergency use only".

Don’t worry, they will figure a way to blame it on the truck who was not in the travel lane and not even moving at the time .

This subject of "shoulder parking" has been discussed over and over here on Truckers Report and the "bottom line" has always come out to the total of it is, as the law states, unless due to an emergency, it is illegal to park on the shoulder or a ramp of an Interstate. It is a given fact that a lawyer is going after the truck driver and his company and rightly so. If it is proven the truck was on the shoulder because of an emergency, the driver and his company has nothing to worry about, but if he was there for any other reason, he was breaking the law. Now we all break the law everyday, one way or another, most of the time, we get by, but it caught up with this driver. There are two kinds of people in this world, "caught and uncaught", he got 'caught".

The issue is the finality and complete destruction of a vehicle crashing into a parked truck. Speeding, not signaling, missing log entries, lane usage, or even a missing mudflap is not the same as foolishness of parking on the shoulder of an interstate. Even Nascar has enough sense to limit speeds to 45 along the parking pits. Why?
Yet, we have 1000's and 1000's of inexperienced, unprofessional, ignorant drivers every night parked on 70 mph roadways.
Most truck crashes on the shoulder are 100% preventable. Most others less so.
Shoulder Parking has about a 10% survival rate for the victims of negligent parking. Roughly the same for head on collision. We have some 'dont drive in opposite direction' posts but those accidents are rare. Shoulder Parking tragedies are multiple Tragedies everyday, 365 days, and they're preventable.
All others are around a 70% survival rate.
The number of Parking fatalities has skyrocketed in last 2 years. All others roughly equal to mileage levels.
Also, to answer your point, this section of truckers report is for accident and crash reports. Its not illegal truck driving/ maneuvers/ speeding segment.

I have said this several times, you depart from your lane and collide with something, that's on you. A vehicle is in the middle travel lane and leaves it and collides with the vehicle traveling along side, who in their right mind would suggest the vehicle that has been collided with is liable?
Now, I have been a workers' comp adjuster handling both trucking companies as well as manufacturers with trucks. I crossed trained to liability, and looked at some of these liability cases. And I saw one where the truck couldn't make a right turn, so he backed up and tapped the car behind him. This case had paid out $30,000 in 1999 dollars, and it hadn't settled yet. Trucks have deep pockets, so they go after us. So for that reason alone, but there are plenty of things in the breakdown lane a vehicle can collide with. Here is what blows my mind on shoulder parking. Truck goes right by a off ramp or an on ramp, then pulls off on a narrow shoulder. Makes a person wonder is the common sense of that driver?? But a word of caution even using a ramp, ramps are part of the Interstate and I know here in Virginia, you will be subject to receiving a citation. South bound on 1-81 MM149 you have a set of scales, you are allowed to park there, but trucks will go right by and park on the shoulder, unbelievable.
