Correct, you will not be criminally charged.
Civil charges is another story... However--I would surmise that for this to be applicable, we are talking executive type occupations. For example; if their lying caused the company to lose money, they absolutely can and will be sued.
Entry level blue-collar workers? I'd think just the lawyer's retainer would make that cost benefit equation out of the question for the employer....
