I am just curious...if a CDL holder smokes a joint...
Is the act unconditionally illegal or...
Does it become illegal only if it is within the time frame of the body still containing the detectable toxic elements and the CDL holder operates the CMV before the toxins are gone?
In other words, if I decided to try some cannabis products and then wait for as long as it takes for my body to leave no trace before getting back to the truck, would the act of consumption of cannabis be still illegal in terms of FMCSA rules...e.g. if they found out about it, or as long as you drive while your body does not contain toxins, it doesn't matter?

It looks like there's nothing to prevent a company or consortium from requesting a drug test while someone is off duty. It looks like the only good way to get around it is to quit and get rehired.TallJoe Thanks this. -
Let's say that a CDL holder has decided to legally smoke pot at the time of his friends reunion - for example, during a week long camp in wilderness. So, he quits and is no longer a subject of a drug testing from his company. He indulges a little bit, then waits 30 days or however long it takes for his body to leave no trace (are there personal test kits like that available so it stays confidential?) and only then gets rehired. This seems awkward and perhaps only a few can afford such a prolonged vacation but, practically, it should work. Yet, I wonder, if doing something like that, is still considered illegal, from the angle of FMCSA.Lonesome Thanks this. -
FMCSA doesn't care, as long as you're not employed in a CDL position. I do think they should not accept hair follicle tests, though. It looks like someone can fail a hair test, then take urine tests to return to duty, but then still be able to fail a hair test but it's suddenly ok to work now after the whole ordeal.
