    I’m aware of that.

There are too many carriers to list that also do non DOT drug testing as a requirement for employment.

    Rahat Thanks this.

I want to add another point to my last comment. Just as I said in an early morning comment about a physical. The ME is required to report the results by the end of the next business day. I can't control what they do with a failed physical or an incomplete one waiting for further information. Some MEs make the report and some don't. The rules say they are supposed to make that report. Now back to the DOT testing. If a carrier has an arrangement with a lab or an MRO to basically violate 40.85 that is on them. I can't do anything but quote what the rules are.

This opens up something that gets me so angry I could chew metal. People in the transportation industry as well as Medical Examiners heck even DOT cops are not 100% following the Law and the rules. As I stated, all I can do is quote the rules.

I know of three. They are balancing a positive for a nonprohibited substance with DOT-prohibited substances. If a driver comes back positive on a non-DOT urine test for say the Devil's Lettice they are not disqualified per the rules. Of course, the testing carrier might fire them, but all that carrier can do is list why. They are free to find another job. One of these carriers fired a driver for testing positive for a benzo. He was attending orientation that next week for another carrier. I remember that like it happened yesterday. The carrier tried to get him back, but he gave them the you are number one sign!

I was not talking about hair testing. The three carriers I was referring to use a local lab. I am not 100% sure but they may be using some of the same labs that process hair samples. Now, I have to admit I am leaving a lot out. Every one of these carriers employs people that don't have CDLs. One is the back end of a cross-dock and uses both CDL and non-CDL delivery and pickup vehicles. Their insurance carrier requires all drivers to be tested. You can't drug test a non-CDL holder in the DOT testing.

I’m thinking that somewhere in this thread you misunderstood what I was saying..

Obviously the OP can and should pass the required DOT test. I was merely pointing out the fact that many carriers also have their own pre employment drug testing requirements.

I called and asked my carrier, and they said they go with the DOT certificate.

During a road trip I met a truck driver and he was talking good of his Carrier, so I have decided that I will go with them.

No I haven’t misunderstood you. My point was, still is you you can’t mix official DOT testing with non DOT testing! you can’t use the same samples, DOT test require urine, non-DOT you can use hair urine or whatever body fluid you want to test, you just can’t mix with the DOT testing, this is one reason there is so much #### confusion on this subject! Also for the record, hair testing, and most of the other non DOT testing generally is done with pre-hire situations, not random. The situation that I spoke of earlier was a random. It was a screwed up situation, and I do not for one minute blame the driver for sticking up the old number one at that old carrier! In fact, his situation is why I really wished when it comes to CDLs these carriers would stick with the requirements of part 40 and 383 there would be much less confusion if they would do this!
