I am not a driver, but my employer uses DOT standard breathalyzer for testing. I have an employee that had to be tested during their shift, and they blew .053 the first time and the confirmation blow was .039. Am I reading the DOT standard correctly that the .039 is the results you use? Also I read that both test have to be within .002 of each other or the test is invalid?

If I was an employer and my employee was working and blew anything but triple zeros they would be fired immediately. That aside, don't breathalyzers need to be calibrated fairly regularly?

Here is a thought, hope your company has a really good lawyer because no matter what you think you can do to this employee, you need to get the cops involved to do a proper test.
