The DOT needs a search warrant to conduct an audit?
-
WRONG……. DOT doesn’t bother with this. It’s CARB you need to be aware of if there set up at the scales. Or Wherever they surprised set upJubal Early Times, 77fib77 and Opendeckin Thank this.

You really told me.

The only thing the government cares for is to have more trucks on the road in order to keep the rates low.
But because a lot of people get paid to enforce the regulations, few unlucky truckers will get in trouble.
If the government really wants to put the deleted trucks out of business they will do it very quickly.Last edited: Aug 18, 2023

they do it in CT and NJ for sure, as I have had roadside sniffer tests done in both states, I have heard guys get stopped in NY as well though it has not happened to me personally.exhausted379, Tb0n3, Oxbow and 9 others Thank this. -
The DOT sends a letter [certified] and calls the carrier.
They do not come in with a warrant BUT they don't just go through everything willy-nilly on their own if you cooperate.
The auditor asks for various files and associated materials and you fetch them; I was given a choice of the driver qualification files to give for examination and the auditor specifically asked to NOT see any local [100 air mile] drivers.
What began as a Haz Mat investigation turned into an examination of HOS and found false logs and one post accident testing where the clinic failed to do the BAC test.
Fortunately, the terminal produced a copy of the clinic order which did request the BAC.
I failed to notice the deficiency, and was directed to insert an explanitory letter [per regulations] to complete the file and she added an additional $6,000.00 to the fines for the falsification.
Just like that lamp that is out when the DOT inspector checks and you get it lit; it is still a violation.
I'm sure if you demanded the auditor have a warrant; they WILL get one and you will probably regret it.Last edited: Aug 18, 2023
