I was opening the doors to a trailer when the left side handle became stuck and needed a little extra elbow grease to open, so when I did get it to open, something also popped in my shoulder and I'm in pain. I called up dispatch, but they're telling me they don't believe this counts as an 'incident' because it wasn't an accident, so they shouldn't need to do the paperwork on it. Does this sound right to anybody? I currently have limited mobility with my arm and the pain becomes extreme when trying to stretch it out to my side. I always thought companies are supposed to take care of medical issues when they occur on the clock, but I've never had any issues like this in my 20 years of work experience, so I need some guidance.

I was on duty when it happened, I also sent in a message through our system to document what happened. I'll call my main dispatcher tomorrow, and I'll also call safety to have everything put into a report. Thank you for your reply.Kyle G. Thanks this.

Sadly, companies are trying their darndest to stay away from any health claims. Every claim probably triples their rates. Don't be fooled, happened on the job, should be covered. They will cry and moan, and will probably demand some sort of proof. Even if you get a dr. to prove there is damage, without proof, they will say it could have happened anywhere. Doesn't sound too good, my friend.

This is an on the job injury - contact your safety, claims or HR department. Seek medical attention immediately and save all receipts and paperwork. Keep records of all conversations and the names of people that you talk to relating to your injury. Copy everyone on all email's! Consult with a workman's comp attorney for guidance.

If it happened at a dock, unless there is some kind of video actually showing this person struggling with the door, and the ensuing pain, I really don't think they have a chance.

Your only choice is make an appointment to get your arm looked at and start the process to get it healed. Tell the doctors office this is an on the job injury. They will handle the billing to workers comp.
Your employer has no say on if this a covered injury that up to the workers comp insurer. There is no need for an attorney unless your employer refuses to give you the policy number, don't actually have coverage or they to retaliate to you for getting hurt.
Every worker will get hurt sometime in there career just get it fixed and get back to work pain free.BillyBobFrank Thanks this. -
In some states there's a time limit on reporting the injury. Get to the doctor as quick as you can.
