Failed drug screen, can I use my new authority?

    I'm still doubting insurance companies can see a failed result. And nobody has posted any definite answer there.

    I never knew i needed a pre employment drug drug screen, or the consortium, until my new entrant audit. The insurance company didn't need the drug test results or consortium to insure me.


    So while SAP may be a DOT requirement, i'm thinking that would be the only hurdle for an OO

    Yes, it was a pissed test. I’ve completed my SAP PROGRAM and I am trying my best to get back to work. I just wanted to know if that’s going to be an issue when I book my loads?

    • Consortia and/or third-party administrators
    • Employers to include motor carriers and others in the transportation industry that employ drivers who operate a commercial motor vehicle (CMV) requiring them to hold a commercial driver’s license or permit
    • Law enforcement personnel
    • Medical review officers (MRO)
    • Substance abuse professionals (SAP)

    I was told that if you’re an Owner Operator with you’re Own Authority shipppers, dispatching service, and loads board do not look into your background. Is it true? If so, then I don’t think it should be a problem going back to work with my Own Authority.

    OP, so you are trying to end-run the system by being your own carrier.

    Why not just apply to second-chance companies and get a job to get back on your feet?

    I mean insurance isn't going to be cheap and while you can sort of hide the SAP from them, it will eventually come out, because if they ask, you can't lie or they drop your insurance in a second and all the other insurance companies will know why.

    Right now it isn't the time to waste money, things may happen, with a greater chance of happening that will put a lot of marginal operators on the rocks very quickly.

    AND let's not forget that if you get into an accident, you as an owner is on the hook for your driver, you and both can be sued.

    They don't have access to them but they have access to what you have on record to confirm what you say is true. There isn't a law or regulation that says an insurer can't see your records if there is something that doesn't seem right.

    Those listed are the only ones that can directly access the clearinghouse. Of course your insurance can request the info from you.

    No. It wasn't Nixon. That was an accusation by one of his former staff, but it isn't true. It isn't even plausible. Marijuana has been demonized since Harry J, Anslinger, the director of the Federal Bureau of Narcotics claimed it made black men go crazy and want to rape white women. That was in the 1930's and marijuana has been illegal since then. The FBN was in danger of being absorbed into the FBI and Anslinger needed a crusade issue to save his agency. Over time there have been other special interests that have lobbied and propagandized against marijuana. Most prominent among them being the alcohol industry for obvious reasons. Nixson and most later presidents have crusaded against drugs, including marijuana, but Nixon only invented the term "war on drugs". He didn't actually invent the war.
