If my employer doesn't pay me after I quit?

    That's the hard guy answer. Unfortunately for me, he knows I'm not going to try to beat him over this. Not going to have my first criminal offense over this.

    I didn't mention anything about violence. Lots of times though, in person visits seem to have a bigger effect than over the phone dealings....

    There’s no grudge, but there’s no such thing as a 1099 employee. And the more people that do it and get screwed over then the government tends to overreact and it affects true 1099 contractors. Anyway, you can’t go to the labor board, court is your only hope.

    In the days where most drivers cannot look anyone in the eye, talking face to face will make you stand out. Especially if you can do so and be non threatening. Non threatening dudes are not threatened. If he threatens you, call the cops.

    I may be wrong, but I get the feeling that OP is preparing for the boss to stiff him. So, he has seen him do this before to others, yet continued to work for him. If he had stiffed others, you should have walked. You shouldn’t be owed more than one paycheck. If you are, SHAME ON YOU.

    OK. I thought this was a classic case of understating the case.

    He's in Florida. That's where I'm supposed to drop of the truck. Get on a plane and fly back to Michigan. We'll see. I'll be in Michigan before my last two direct deposits.

    Tell him you will report him to the State for mis-classification and non-payment for work. The State will investigate and you will be owed the extra money that was taken out as a 1099 worker vs employee. And any unpaid wages. Check online for your state and where/how to report. Call them, give them the details, they will help you. And he will get audited and owe for others too. Many don't know what to do or take a little time. I have reported multiple companies for misclassification.

    I won't have the driver facing camera again. I'm 60 years old, trying to hold out until 70, then they can replace all of you with robots and you can choose "welcome to Walmart" or "would you like fries with that". :)

    You might be the guy I'm looking for. Was hoping for a little more detail than "the state".

    As far as misclassification, I just want my money, if it comes down to it. Next guy I work for may just be another small fleet owner.

    Paper Transport, the put it on my DAC they fired me for violating company cell phone policy. I feel like that has made me toxic with larger carriers.

    I've worked with 2 small fleet owners now, and that's usually 1099. I don't care if the IRS doesn't care and they certainly seem like they do not.

    Driver facing cameras? Kiss my....
