Fraud company

    Hi I wanted to get advice also alert people..I posted a truck to be moved from Colorado to Florida. For transport. A company called me said they will transport when they when to pick up the guy sends me pictures of the truck on the floor but not on trailer when. I asked he never answered back with no pictures or anything then he arrives at my location driving the truck he drove truck with no license or insurance then we called police the officer came said that's a civil matter we can get into this . The guy supposedly said because I put on the order I'd can be driven he decided to drive truck it that was there because most truck are inoperable don't drive and this one did..so police didn't do nothing I had to pay this guy because otherwise he was going to take my truck and yet he said I'm scam ..I need advise help from someone

    The company drove the truck instead of hauling the truck. There was no insurance on the truck and driver didn’t have a license.

    Driveaway transport, happens all the time. Unless you specifically said haulaway only most truck transport companies are going to drive the truck. The legitimate companies have their own insurance and transporter plates, so it is legal. Even if the truck is already registered they will put their own transporter tags on it and cover the displayed name and DOT number.

    Police are correct, it is a civil matter not a criminal matter. Even if the driver is unlicensed and uninsured, unless they witnessed him driving it they have no grounds to charge him with any crime.

    This is why you need to read the contract language when you ship something, or ask questions to get clear answers. I have transported trucks all over the country as driveaway and the customer always knew what we were doing.

    That was pretty much my take. The guy got his truck. Now it sounds like he wants to stiff the guy who did the work.

    Based on the text of the op it’s pretty obvious there was a lack of understanding. So I made mention of this because in this case it is certainly relevant to the situation. In addition, I pointed out that because of his actions I felt he was the bad guy, not the guy he was calling a fraud.

    However, my post got deleted.

    I'm still confused as all get out, but the OP might be upset because of the liability he took on by this guy driving it without insurance because at that point he owned the truck. If the accident injures someone, the lawyers go after the insurance company first, and without one of those, the owner of the vehicle.

    This is something I'm not familiar with but I'm pretty sure you're not on the hook to pay someone for illegal activity. I know I've seen court cases (albeit on syndicated TV but they do, for the most part, follow the law) where someone did illegal work and wanted to be paid for it. Examples might include building something without the proper permit, installing sewer lines without getting city lines marked for electrical, water, etc. In that case, sometimes they cannot charge for the work, or can only charge a partial amount with the understanding that the full amount would only be paid if the full job had been completed, which included the expense the company would take on by getting the proper permits, etc.

    I'm not really sure what could be done in this case. It would be like hiring an electrician to wire a house and he used all the wrong materials and the work isn't up to code. You don't have to pay for that. Heck, he would have to pay YOU to have someone undo his work and fix it correctly.

    We only have one side of the story, and it was a one hit wonder, so it may not be very accurate. I am not sure there was anything illegal about it, especially if when the local police were called they agreed it was a civil matter and were going to allow the transporter to exercise his right to impound the vehicle for non-payment for service rendered.

    He claims it wasn't registered or insured, however if he hired a reputable truck transporter they will have their own transporter tags and insurance. It is perfectly legal, and the owner doesn't need to have the vehicle registered or insured, that is part of what you are paying the driveaway transporter for. I believe he didn't understand what he was ordering, because very few truck transport companies haul large trucks, most of them drive them, to keep the rate to the customer affordable.

    I would love to see the contract or other paperwork, or even know the company name of the transporter he is claiming a scam company. I can tell in three seconds if they are a legit driveaway company and if the OP simply didn't understand what he ordered them to do. I offered haulaway, which was very expensive, or driveaway at a much lower rate because it didn't require any equipment of my own.
