Is your dispatcher allowed to make a driver take a trailer to the shop knowing it has a flat tire?

    Is that against the law to knowingly drive a trailer that has a flat? I was asked to pick a trailer up from one of their yards and take it to a shop.

    While it is illegal, it's also very normal.
    Especially if the shop is only a few miles away.

    Its a DOT violation/illegal to run a trailer with a flat tire.
    NO ONE can legally make you violate the law. They can't ask you to do something that is illegal.

    But, yes, I have taken a vehicle to a tire shop many times with a flat on it.

    § 390.6 Coercion prohibited.
    (a) Prohibition.

    (1) A motor carrier, shipper, receiver, or transportation intermediary, including their respective agents, officers, or representatives, may not coerce a driver of a commercial motor vehicle to operate such vehicle in violation of 49 CFR parts 171–173, 177–180, 380–383 or 390–399, or §§ 385.415 or 385.421;

    (2) A motor carrier or its agents, officers, or representatives, may not coerce a driver of a commercial motor vehicle to operate such vehicle in violation of 49 CFR parts 356, 360, or

    Thanks for responses. I know it’s normal but, I just wanted to know if was it illegal.

    The moment those tires hit public roads, it's no different than being on an expressway. A flat tire is a flat tire.

    The way DOT sees it, you can have the mechanic come to the trailer. You don't have to take the trailer to them.

    The question is "how flat is it?"

    Technically, as long as the tire is greater than 50% of its maximum psi, it's not flat.

    The other "loop hole" is 396.7(b), which allows a driver to move to the 1st safe location for repairs of a defect found "on the road". Trying to use this is rather weasely, but might get you out of a ticket.
