While I won't argue that, 99% of truck drivers that get booted have 0 concept of what private property actually means.

How is it a scam when the locations in question are clearly signed no truck parking? I posted in the other thread about this and showed pictures of both locations with multiple signs at the entrances saying no truck parking.aussiejosh and Lonesome Thank this.

Lots of places have signs. Whether the truck is parked according to the posted signs is not at issue. It is parked illegally. What is at issue is who the clown applying the boot is working for. He is an unregistered business that is not doing the booting at the property owners direction. If he was a legitimate operator doing this at the direction of the property owner or a legitimate representative of the property owner that’s fine. You can’t just purchase boots and go around placing them on vehicles and pocketing the money. Yes, but even if you do park illegally on private property you must be given a chance to leave. Otherwise it's extortion and possibly kidnapping. This only holds true if you're still in the vehicle and there are no visible signs banning you from parking there. You can be trespassed from the property, but you can't be trespassed and then prevented from leaving with a boot. I mean you can, but none of this would hold up in a court. Now I believe if you are trespassed from the property and return, you can be booted without warning. Trespassing is a weird law. One of the only ones on the books that you must actually DO before they can prevent you from doing it again unless someone specifically put up signs disallowing it.
I'm pretty sure you have to be given the chance to leave. Because illegal parking is a form of trespassing. Trespassers must be given a chance to leave. It REALLY gets confusing when you have a legal right to be there at some point, such as delivering or picking up. Then laws get real whackadoodle. -
So Walmart just allows anyone that wants to to go ahead and post signs on their property with the company name and phone number? Interesting.
Either way, if drivers didn’t feel entitled to park wherever they want then they wouldn’t end up in this situation to begin with, legal boot or not. Ignore any sign and expect some consequences.Lonesome Thanks this. -
I got booted one time. Normally I kept a spare steer tire and rim on my truck but there was a tote of Red Diamond sweet tea back there on the catwalk. I was developing an engine to run on it before a hydrogen fuel company bought me out.
I didn't have the cash to remove the boot and refused to pay on principle. The US Marshalls were busy so I just wheelied the Kenworth back home 500 miles feathering the clutch. Swapped the spare rim on and took a load of pharmaceuticals to Colorado, made it with time to spare.
The excess smoke is from the red diamond running a little rich.
