The company can make up all the rules it wants but if you were involved in an accident on your way in and behind the wheel ??

It's still a commercial vehicle, you might not have to log etc. but the company is still responsible for it.

I would be interested HOW you ran out of driving time. Just by your screen name you are probably entering Canada and gain an extra 2 hrs to drive Canada and 16 hrs to do it providing a 2 hr break during the day.

You DO know that the FMCSA ONLY governs your hours driving a CMV, right?
It may be a "commercial vehicle" in YOUR vocabulary, but under the FMCSA (which makes the RULES), it is not a COMMERCIAL MOTOR VEHICLE and therefore is NOT SUBJECT to hours of service restrictions, which I have already shown by posting from the FMSCA website itself.
Can ANYONE hire a lawyer and go to court for anything? Sure. Are they going to win? Maybe, maybe not. This isnt a court. You arent a lawyer. And Im not defending the rules, I am just pointing out what the rules are. Dont like it? I dont care...Gomer1969, Crude Truckin' and Hatt91 Thank this. -

257.7 "Commercial vehicle" defined.
Sec. 7.
"Commercial vehicle" includes all motor vehicles used for the transportation of passengers for hire, or constructed or used for transportation of goods, wares, or merchandise, and all motor vehicles designed and used for drawing other vehicles that are not constructed to carry a load independently or any part of the weight of a vehicle or load being drawn. Commercial vehicle does not include a limousine operated by a limousine driver, a taxicab operated by a taxicab driver, or a personal vehicle operated by a transportation network company driver. -

Which is EXACTLY what I said in post #8. Thank you. And HOS rules are on the FMCSA, not the state of Michigan. Again, we are talking about CMV under FMCSA. (CMV means commercial motor vehicle as defined by the FMCSA - not by ANY OTHER definition). And I will point out the Michigan law isnt talking about "commercial motor vehicles" - they are talking about "commercial vehicles". Not the same thing (which is why there is a difference). Commercial vehicles are for state tax reasons. Your license plates. F150 pick-ups and above are "commercial vehicles" in the state of Minnesota. They have special plates and are taxed accordingly (they are called "Yankee plates" because they all begin with the letter "Y"). But amazingly enough your average Joe driving an F150 isnt filling out logs to drive it...Last edited: Apr 22, 2024

And must have 10 hours off before your next tour of duty. -
