Citation for suspended license. Medical card was not updated. KS

    Hello, Folks
    Driver got citation in Kansas for suspended license due to not updating his medical card in the system.
    He did get his medical card at state authorized private medical center a week or so before expiration, but forgot to update it with Secretary Of State (DMV) of Illinois. He got citation a week after expiration. He got all paperwork to prove:
    - medical card (with date 2 weeks prior getting citation)
    - receipt from Illinois DMV date that CDL was updated
    - and we also can get letter from DMV stating his license is in good condition.

    BTW: he was in parked in lot when he got citation, he wasn’t actually driving.

    Called couple of lawyer and quoted $3,500. And if there is a trial, extra $2,500 would be added, so total $5,000. I think he is banking on desperation.

    Any advices? Is it wise to go to court alone and just admit an honest mistake (which it was and he clean record)?

    I would go to court and represent myself. Or pay the fine if not too much $$$. Stress to the Judge it was an honest mistake etc.

    It’s not suspended, it’s just downgraded to a Class C. I would go to court like @Allow Me. said. I’ve seen a lot of individuals lately doing this by not going directly to DMV themselves to turn in the medical form. They claim the facility they went to will process it, “I don’t think so Tim”…… I prefer to handle it MYSELF.

    I guess there is no interconnection between KS and IL. I called court clerk and asked if I could send all details and proofs plus pay the fine since its more or less far from where he lives. Clerk said he has to appear.

    He would have paid the fine if there was an option. The court clerk said He has to appear in court.

    Wait, they are connected, who suspended the license?

    Illinois?

    Then if so, have your lawyer write a letter to move this along out of the clerk's hands.

    So I assume you are a fleet owner, you do have a company lawyer?

    Kinda curious, ‘parked in a lot’ when got the citation. What caused that to happen?

    I went to the Texas DMV to update my medical certificate. The clerk said she updated it in the system but said she had no receipt she could give me. Sounded strange. I don't like having to rely on her word.
