If there is death, injury or if a vehicle has to be towed you are supposed to get drug tested. I’ve only had one major accident and all three happened. So I had to be drug tested. I think the company came and got me. But I do remember the officer asked if I needed a ride somewhere and gave me a ride to the sheriff’s office to wait on my other ride. This was two decades ago so I may be forgetting something. But I do know the police don’t just leave you stranded. And if you were already at the hospital they would have gave you the drug test there. So Who is responsible for issuing a drug test? The Police? The Company? I had an accident considered a major by definition, because my vehicle was towed. No drug test. Later I had an in house audit. Drug test was never mentioned.

They did a urine and blood sample at the hospital before I was discharged. That's why I was wondering how the company could put a violation on my clearinghouse. When fmcsa regulations state a drug test performed at s hospital is sufficient.Flat Earth Trucker and Rideandrepair Thank this.

I’m lucky they didn’t catch that on my audit. I always thought the Police would be the ones to enforce it. Kind of like they do with DUI. I did get quite a few “randoms” afterwards. My Consortium obviously suspected I was using drugs.Flat Earth Trucker and Atlanta trucker Thank this.

So one was done post accident. That satisfies the fmcsa requirement. They can test you every day if they choose. You are required to go. If you fail to go it’s counted as a refusal and is reported to the clearing house. They are not required to provide you transportation.Rideandrepair Thanks this.
