Question about driving on hometime??

Technically, if the trailer is loaded, then yes it is supposed to be logged. In the real world, would anyone do that? Probably not. It is virtually undetectable and not a major item. Unless the driver does something stupid enough to draw notice to himself and DOT stops him (a highly unlikely event) during the trailer move, probably nothing to worry about.

 

"technically" any time you drive that rig, loaded or not, you need to do your log. this will indeed disturb the 34 hour rule. you need to CYA in the event of an accident while doing this move. i'd personally rather have to reset the 34 hours than to NOT have a log up to date in case of any sort of accident.

 

Even bobtailing back in the day before Prepass you were supposed to pull into the scales when driving. In a truckstop I always went to the berth to do my paperwork. Front seats is suppose to be on duty not driving DOT can check you out if you are sitting in the front. If you are driving and something happens your log better say driving. Your case is not an every day case, but could prove to be iffy.

 

You can bobtail from terminal to home but you must be bob tailing and you can use your truck for personal use (as long as the company allows you to?) to do laundry eat etc. However when you are driving to pick up a load (leaving home to work) you must log this time as driving. Personal use time would be logged as off duty. You can't bobtail to pick up your load and not log it.

Your 10 hour break or split breaks should never reflect any driving time except maybe to move around to the back cause someone won't turn their radio off etc.

In your situation you was hauling a trailor therefore DOT technically states you should be logging it. Now what the 2nd post said may be possible, if I was reading between the lines correctly. I however don't and can't tell drivers to get around the system. I would just feel to guilty if something happened.

 

I can't see any company allowing the use of a company truck for personal use. I know of one man who when he comes home drives his truck to walmart to do shopping and takes his wife and kid in the truck with him without the companies knowledge. He drives the truck around town like his own car. With the price of fuel and added exposure to accidents I find this hard to believe when he tells me the company is alright with it.

 

most companys do let you do personal business.the problem the person you are speaking about might be in trouble with is allowing a passanger that could be a big NO NO

 

Yeah I had something typed out and well I am tired so wasn't sure if it sounded right or not and decided not to post it.

You are right! Most companies do, and it is a VERY BIG NO NO NO HAVE AN UNAUTHORIZED PASSENGER on the truck, you will lose your job if busted! Some drivers get busted over silly things like ticking off a driver on the road and they call in to the company and make statments such as the driver had kids on the truck and had no right acting that way but it was really bad becaus there was kids on the truck. So tell your friends to watch out!

Someone is always watching you guys and reporting silly things you might do!
