Is taking a fuel surcharge from a company drivers pay legal?

    Yes, it is legal provided it is disclosed, or open and apparent to you. You are not being defrauded if there is disclosure. In general, an employer is obligated to pay a driver only at least minimum wage for all hours worked during a pay period. There can be civil claims for failure to pay all wages earned, which would be similar to a breach of contract action. For example, if they promised you 40 cpm based on RandMcNalley Practical and paid you based on Household Movers Guide, and did not tell you about it, or you did not know about it.

    I had a friend of mine that drove for a company in western pa, that charged his driver's a fuel surcharge. The driver's got together and hired a attorney. The company had to pay the driver's back for the surcharge they took out. So I would say it's totally illegal. Actually I'm the one that pointed it out to my friend.
