I was wrong when I told you my advice; I assumed that either the contract had in it or you added in the clause (which you can do) that talks about detention time and TONU situations. This is something YOU have to force into the contract and make sure that the offer and the rate confirmation do not exclude these provisions.

So because of this, I think you just need to eat the costs, get the broker on your never haul list and move on.

What good is DOL going to do? I assume your driver of the truck and company you own is the one who was released, right?

We do have records we arrived. And we have phones for our digital time stamps. Also, we used tracking.
With so much technology these days, people have lots of records. :)

I completely understand the desire to do this, and I'd be lying if I told you I hadn't succumbed to this temptation a few times earlier in my career, but I personally believe it's a trap. It might feel good and "righteous", but it's unlikely capture any dollars for you business and the time and money wasted will actually hurt your business. One of the tricks I've learned over the years that has helped me and my teams be successful is that in this industry sometimes you can do everything right and still get screwed over, and in those scenarios you learn from it and move on rather than spin your wheels trying to figure out a way to snatch a win.
