Well I'm sure a lot of money exchanged hands to give the motor carrier the responsibility to make the determination on a drivers English language proficiency. Obviously they saw the money that could be made by exploiting foreign drivers and the rest is history.
Now it's just gotten out of hand and American companies/workers can't compete with carriers that disregard the law. English language proficiency has always been a driver qualification requirement, it's just common sense.
Is it the only issue? No of course not but it is impactful. We finally have a president standing up for the people who actually have to live and work in THIS country. I think that's a good thing. -

I have a better idea.....and this is no joke.
Established a recovery operation for trucks that are OOS. Simply go to the sites and recover the trucks for a price.
Back to the yard, $$$$
Deliver the load and back to the yard, $$$$$$.

but i think the major difference would be that Billy Bob Smith, is a BORN American, where as the foreigner comes here, thinks he is "entitled" to everything, and will sue if he doesn't get his way due to discrimination....and of course the people that allow him to stay here, that will fight for "his rights".....
Billy Bob's issue would be (maybe) had to work the farm at a young age so could not attend school, or lived deep in the woods, and way too far to a town to get to a school. -

It was certainly used in 2001. Had a team that one driver was put OOS in Utah.
They left and went back to a Ca carrier.
In my 2003 audit I was fined $1300 for that violation.
I'd known the son for years, perfect English. I just had never actually talked with his father.
If the state(s) adopt it as a traffic law then there can be a fine at the scale, if not the carrier can get an administrative fine during an audit.ElmerFudpucker, Concorde and D.Tibbitt Thank this. -

Yes I understand, CVSA listed it as an oos for some years but wasn’t the fmcsa’s intention.
