California Truck Driver Fails English Test

    That depends on your entrance visa type, and it's the employer who has to show the need, not the employee. Asylum seekers can get a work permit without having to meet this requirement though.

    The ATA and its manufactured "driver shortage" has been and will continue to be one of the biggest detriments to the industry. They see no profit in anything that's good for you, the American driver.

    I have been noticing the same thing, but have been thinking it might just be confirmation bias. I haven't bought a reserved space in weeks though.

    I don't think it's confirmation bias, rather it's confounding variables. Capacity has been shrinking since last spring, just not as fast as freight volume so rates remain stagnate.

    English test? Shoot, half the CB chatter wouldn’t pass that either.
    But we still get the freight there, don’t we? :D

    . The driver's employer is responsible for sending another driver who is proficient in English to recover the truck.
    The reevaluation process for the OOS driver is also managed by the driver's employer.

    An Interesting part of 49 CFR § 391.11(b)(2)
    "Personnel who perform inspections of motor
    carriers and drivers in the United States
    engaged in interstate operation of commercial motor
    Vehicles as defined in 49 CFR § 390.5T. However, when performing inspections of drivers
    operating commercial motor vehicles in the border commercial zones along the U.S.-Mexico
    Border FMCSA enforcement personnel should cite drivers for violations of
    49 CFR § 391.11(b)(2) in accordance with this policy, but should not take follow-on actions of
    placing the driver out-of-service or initiating an action to disqualify the driver."

    Remember back in the day, you are approaching a weigh station and a driver would pop up on the CB asking if a truck with a team would pull in and drive his truck out of the scale because he got put OOS for being out of hours. How long has it been since you heard that? Not that most don't run with a CB now.
    But will it be heard in Farsi, or some other foreign language?

    I just watched a video where an Arkansas police officer was telling the trucking company that their truck and trailer were being impounded until the company sends a driver proficient in English.

    Nothing, once they get the truck out of impound. Think of how many spot market guys will jump at $500 to uber to the impound and move the truck back to the truckstop. And once the original driver gets back in the truck it's likely to be 6-12 months before he's inspected again. Total cost to the carrier is less than $3,000 - hardly a deterrent.

    What happens when they pass an ELP test in Texas and fail one in Arkansas in the same day?
    Lawsuits?

    Food for thought..what if a CDL, all cdls yours mine and every person from foreign lands had a symbol on their license showing ELP compliance. Just seems too simple a solution that wouldn’t attract lawsuits and wasting resources.

    At renewal we all take the test. Pass and it gets renewed. Fail and it gets revoked on the spot until you can pass the test.

    No one gets discriminated against and the DOT gets more time to check for equipment and ELD violations.

    Too simple..
    Inability to politicize it on a daily basis.
