False cargo claim

    Anybody can advise any good lawyer who represents motor carriers in Ohio state. I have a false claim from a broker. I have all the proof, looking for an attorney who can represent false cargo claims against the broker. I have been restricted from talking to executives. I have been restricted from having direct conversation with the receiver. Have been told by them that my case is in the claim department and I have to deal with them. I am only allowed to talk with the claim team. They stretched the time about 4 months talking to me in reference to fair resolution and at the end forced me to pay. My factoring company was not able to hold three unpaid invoices totaling almost $14000 for more than 100 days and I was forced to pay. The broker extorted money. They always lie over the phone. They never responded by email after the delivery. Only twice when they posted the claim. I submitted all the evidence and written proofs and nobody responded . After 120 days I was forced to pay a claim and cover my losses.

    Did you file a claim against their bond?

    What was the “claim”?

    Were the 3 other loads for the same broker?

    Yes , it was same broker. I was forced to pay a claim amount in order to release other payments for other loads which I delivered previously before this claim and which the broker was holding illegally.

    Bond told me the claim on the load and refuse to take case .

    They can't keep you from talking/working directly with the claimant. Unless you just lay down when they say you can't.

    Bond company has nothing to do with resolving the claim.

    This is email I received and million phone call after I contact the receiver : "I am reaching out to you because it has come to my attention that you, or someone in your organization, has contacted our customer, State Garden, and/or companies associated with our customer, regarding a potential claim . Contacting our customers, and their affiliates, is a direct violation of your Broker Carrier Agreement. All payment disputes, including those related to claims, must be handled directly with us. Any continued contact with this, or any our customer, will be met with legal action. Please let me know if you need a copy of the Agreement. "
