I submitted the temperature log from the Thermo king dealership and the broker has access to the report. According to the report, the pre-cool temperature was 33F, after the pick up it was 34F and during the transportation 35F continuous. So, I did nothing wrong. All clear and easy to understand. Usually fresh harvesting raw baby spinach temperature is highest in the first 24 hours. So the Thermo King report and the SensiWatch Platform proved that the temperature was set according to rate confirmation and the reefer was in excellent condition. The load was intended to fail so that a claim could be evaluated and they could blame the driver. A one degree high temperature setting in a reefer would increase temperature inside the pallets , which would guarantee to file a claim. The fresh harvesting raw baby spinach temperature is highest in the first 24 hours. If the reefer were set at 35F the day one at first 7-10 hours when respiration of baby spinach is highest we would have the entire load temperature high. 1 degree high temperature setting in a reefer increases the rate of respiration, leading to a vicious cycle: more heat is produced. At the shipper I was able to pulp the pallets, I have all the paperwork, but at the receiver they verbally told t me that the 6 pallets' temperatures were high and never allowed me to pulp the pallets. After 5 hours they claim I delivered 9 bad pallets.

I had received the request to set the temperature at 35F. I have undeniable evidence : verbal and written confirmation to change the temperature setting by 1 degree from 34 F to raise up to 35F. The broker suggested to increase. I asked to send me email confirmation. So I have fact that the broker suggested. On the BOL I have strong suggestions from the shipper to Maintain a reefer temperature at 34 degrees. Many times over the phone the broker mentioned that 1 degree increase in temperature is not a big deal. I provided them with a very simple example what would happen if temperature increases 1 degree. Water freezes at 32F , if we increase temperature by 1 degree water will be in the liquid stage. The broker team daily bases were checking a temperature setting to make sure the temperature was 35F. If the temperature setting was not that important, why did the broker's team call daily to make sure the reefer temperature is set at 35 F. Why is the broker requested to change the temperature to 35F instead of 34F which caused the high temperature inside the trailer. Looks like the load was intended to fail so that a claim could be evaluated and the receiver could blame the driver.

What was the amount of the claim? -
My claim amount 8650. The load was paid $8000. I paid for Thermo king report $175.

Run what is on the BOL's. That is why I asked broker to send written confirmation to increase the reefer temperature by1 degree. I do not need verbal confirmation. I really need good lawyer. I have everything to win the case

As soon as you got the download you talk with the receiver(claimant) Broker saying you can't is a empty threat. The receiver State Garden Inc, Boston, MA had very bad reputation. As soon as I tried to have direct negotiation with the receiver the broker start calling. It is against Broker carrier agreement. The receiver was not reply to my emails and never answered to my phone calls. I asked them why you did not leave bad pallets to my trailer. I never received and answer.

Wouldn't even bother with a attorney, file against both in small claims.
Either way the broker will never use you again. -
