Driver caught twice for no English language proficiency

    Driver even peeled the oos sticker off side of truck..


    A commercial truck driver with a non-domiciled CDL from Virginia was placed OUT OF SERVICE in Arizona for failing English proficiency requirements – a serious safety violation. All they did? Slap a sticker on the truck and temporarily shut him down. No impound. No detention. Driver stayed in the cab. License NOT revoked.

    Just TWO DAYS later – the EXACT SAME truck and driver get stopped in Arkansas... and the SAME THING happens again! Out of service for the identical English proficiency violation. Once again: no tow, no arrest, driver not removed, license still valid.

    So I guess by the time the OOS is completed he is supposed to be proficient in the English language? He should be in the sleeper studying, listening to Rosetta Stone? What an absolute joke these DOT clowns are. Here we have a blatant violation to everyones safety on the road and they don't even follow through for the safety of us all.

    A little while back, had an interesting conversation with a Nevada DOT officer.
    The topic was hot shot trucks. Specifically the newer trend of chicago based 3 and 5 car hauler set ups.
    He stated that they were a bit of a favorite, mostly because they usually were over weight, either on an axel or gross. I asked about the potential communication issues. His statement was that all they could do was write citations for the various infractions. If they fixed the issues other than the communication problems, they had to let them go.

    I think I did.

    No hate, just stating what we all can witness: Every truck stop looks like a UN Convention full of translators yet, I see fewer trucks then ever stopped or being towed away from scales.

    I have heard from other truck drivers the same thing; English language proficiency is the one Out of Service order you can drive away from and not face any consequences.

    Don't try that with a burned out turn signal OOS:
    • Driver Penalties:
      • Fines: Minimum $1,000, up to $2,500+ for the driver.
      • Disqualification: 90 days for first offense (non-hazmat/rail) up to 3 years; much longer for hazmat or passenger vehicles.
      • Criminal: Willful violations can bring fines up to $25,000 and a year in prison.
    • Carrier Penalties:
      • Fines: Can range from thousands to over $175,000.

    First I’ll deposit this here…

    Next I’ll address the hysteria over this scoundrel.

    His hypothetical defense..While oos I read a book called “ English for Dummies” and learned some basic English. Resolving the oos issue I proceeded on with my job.

    So, since it hasn’t actually been proven that lack of English is a safety issue it then becomes nothing more than a money grab.

    But as it stands the driver gets put oos, fined $500?? (Referring back to another case where Georgia fined the English speaking Spanish accented driver $500)

    Where it really counts and the way it always was is that the Carrier is responsible for safety.

    So now we have a carrier hit twice with an oos which imo is some serious doodoo. Question now is what’s the fmcsa going to do about it?
    Audit them? Fine them into oblivion? Or just nothing as usual?

    Okay folks, what were you all thinking was going to happen?

    This is the CONSISTENT future of trucking. This steering wheel holder can't even understand basic instruction. I'm now thinking they're prolonging the chaos in order of pushing the Driverless truck agenda.

    ####, these officers have the most patience.

    Corporate America relies on an abundance of cheap labor..just like the hospitality industry relies on cheap imported labor to wash toilet bowls..in essence, truck driving is and has been put on the same level.
    Don’t believe that we’re now no different than toilet bowl washer’s then take a good look how we’re treated by the general public.

    Truck driving has become a crap job and will continue downhill until everyone with a shred of dignity disappears from the industry.

    This isn’t a driverless truck conspiracy.. it would be impossible to replace all the drivers. Line haul jobs could take a hit but vocational truck drivers will be safe. I’d like to see a driverless dump truck back up to a paving box or a driverless truck pump out a septic tank..

    We’ve been divided for many years and now we’re starting to see the results.

    I won’t get into it but I started in 84 as a union driver..life was good.
