    That pretty much sums it up, aside from the driver still just sitting there in limbo waiting to starve to death.

    My instincts tell me that the load out of Alaska paid enough for them to sit and wait. They also have a decent load going back…they have to wait for it to be ready to ship.

    Why didn’t they tell the driver? Because they are being extremely cheap and stiff the driver. If they had told him about it, they would have to pay detention. How do I know? Because no owner in his right mind would sit a truck for 3 weeks without a back haul that paid for the wait.
    They’re cheating the driver. By either the middle or end of this week, they will let the driver know where the load is.

    Driver, do you want revenge?

    Had to pick up a 15x15x15 part of a soybean extractor from the port of Houston going to Grand Forks. We get there Thursday. Delay. Come back Friday. Delay. Come back Monday.

    Monday, a disgruntled driver comes up to me and informs me that there’s no detention on these loads. Yes, there is…you’re not going to see these big specialized trailers sitting around for free. Driver calls his DM. “Six! Cindy says that you are mistaken! There is no detention!” He went and told the others what Cindy said and they come to me asking, “Who is Cindy?” Disgruntled driver leaves and his replacement rolls in less than ten minutes later, smiling like the cat that ate the canary. This driver also was on Cindy’s board and Cindy paid him detention from Thursday.

    Companies are not required to pay layover. Thats just accessory pay. That's a tool to get drivers to work for them. You have a problem. You definitely need to try to solve it. Sometimes you can't solve a problem. The best thing to do in that case is get rid of it. If you're worried about abandonment issues, then take the truck back to them. Get as much fuel as the card will allow. Started heading back to where you got assigned the truck. Hopefully you make it all the way there. They're going to see you moving I'm sure. Then they'll find you a load quick fast and in a hurry......maybe. Give them back their truck, and get home. 3 weeks is more than enough time to sit around. Just take them their truck and fly back home. Hopefully, you have got enough cash to be able facilitate all these moves. Or......you can just go home now, and tell them to call you when they have something. That way you can say you didn't quit, or abandon the equipment. You can just make it seem like you'll come back and get the truck when the time comes, but you're looking for somewhere to work at the same time. A rinky dink company like this probably won't ding your record.

    Now how did you come across this piece of work company? My curiosity looms............

    3 weeks is insane. Your employer should have run ya home on their dime.
    By now you should have sold the wheels, any electronics, ya know just a general yard sale and resign just as you boarding flight home
    Abandoned trucks get stripped all the time

    I’m going to take this one step further, if there is no work for him coming from the company, he is out of money and they have not compensated him for the lack of work or made any arrangements for him to go back to the state where they operate out of, I would consider this as a termination.

    I would be on the phone with the owner or whom ever is in charged and tell them it is obvious you fired me so I am going to leave the truck parked at the nearest truck stop and go home. I would take all kinds of pictures of everything I could and leave for home.

    But before I do that I would seriously look for work in Texas and secure that before you say anything to them.

    if you are worried about abandonment, here is how this plays out. You secure the new job first and then you considered your termination date as the last check you have received from them, not the time you are sitting in the truck. There is no legal requirement for you to consider any thing that they say, your termination date was when they abandoned you. If it appears on your DAC report, counter that with the termination date when they refused to provide you a means to return their equipment and pay for you to sit.

    If you think they will sue you, then they have a problem with that too, you should be able to prove that they didn’t want you back and were relieved of duty when they refused to provide you funds to survive, which was a termination of your employment.

    don’t sweat this crap, it is a crap owner who needs to deal with getting his truck back, you need to get a job and focus on the future,

    Okay guys so here's my update:
    First of all the company I work for doesn't do interstate travel. These are the first loads they do. Usually they do construction/dirt work with side dumps so they don't have a proper "dispatch" just a driver turned supervisor/dispatcher. He informed me that driving through Canada right now left some drivers in bad conditions with the trucks going through severe engine derates. Which I experienced my def freezing up during my drive through it got down to -54 in some spots also I got an Uber last night to the comfort suites with a week of full pay sent over by zelle and hotel paid for by them. Originally the pickup load was supposed to be at the port of brownsville in texas to pick up drilling pipe which something happened with the broker landstar, they said if I could please give it till Friday. The latest, if not, I can either fly home or drive back to Alaska. More than likely I'm going home. And I could not thank you guys more than enough for th references in which I'm already going to look into. I apologize for the late update as I stayed on video call with the wife and kids and slammed a few much needed glasses of liquid courage to have the ability to really set this right with them and not give a f in doing so. Once again I thank you all from the bottom of my soul
