If I need to send something off. Its pretty whack because the cop didn't explain what I needed to do very well. All he said was that this wasn't a ticket but he also said I needed to get the mudflap fixed. Here's the thing, he told me I could drive to a truckstop nearby to get it fixed. So I decided to take the trailer to a dropyard we have in the vicinity (about 5 miles down the road) and let them fix it and I could pick up a different empty trailer and pick up load without being late. I just dropped trailer though because they don't have a shop. I was assuming company will send a mechanic to fix it but now they're saying somebody has to be with trailer while its repaired. Well now that I've gone over the papers that he gave me more thouroughly I can't tell if I needed to get the thing fixed. The last page has "Certification Of Repairman" and "Motor Carrier Certification Of Action Taken". Both have boxes for signatures. The warning was written in Texas in a rather big city (don't wish to name city). So if anybody has gotten an out of service letter in Texas I would appreciate your help. I don't even know if I received an OOS because he said I could drive it to a nearby truckstop. As you can tell I'm beyond confused lol. Appreciate any advice.

Is it a DOT inspection form? If it is then yes you need to send a copy into your company. They only have I think 15 days to send it back to the state. And yes you have to be with the trailer to get it repaired.

Who is saying someone has to be with the trailer during repair? The written warning or your company?
I reread and it is the warning I see...........does that have to be sent in like a ticket or summons? -
So you are dropping off a trailer that you KNOW needs repair for someone ELSE to take care of it. Sounds like a typical steeringwheelholder to me. And you thought a drop yard without a repair shop was just going to magically send out a mechanic to fix a mud flap.

I sincerely hope that every trailer you try to hook to for the next month has a problem that someone ELSE left for the next driver to fix.

Company is saying that somebody has to remain with trailer for it to be fixed. Night dispatch has been kind of #####y about it. I told her she could send me back there on a load assignment so I could get it fixed. But she said she's not doing that. I guess she thinks I was leaving the problem for somebody else or they're pissed I didn't catch it during pretrip (although it could have fell off during route). I left a message on quallcom for my day fleet manager that I was dropping trailer at yard due to mudflap. So I wasn't leaving the problem for somebody else because I let them know. I was gonna leave something on front of trl telling condition but forgot about it due to the fact that I was almost late for shipper and I was tired as hell. Anyways, I'm rambling lol.

I didn't think magic would be required. I assumed a simple phone call to a mechanic would fix the problem. PELOSI?

The point is that you dropped a trailer, knowing that it had a problem, instead of taking care of it YOURSELF. SOMEBODY has to fix this, and "sending a message" and red tagging it, just doesn't cut it. I don't know of any trucking company that has someone especially employed to go around checking dropped trailers to fix problems. Now the next poor slob that needs a trailer, is going to be stuck getting this fixed.
I've run into this far too many times to be able to just "shine it on" and except any excuses. IF THE #### THING IS BROKE, FIX IT!
OK, perhaps you really are green enough to believe this. But you are now learning differently, so you will know next time.
Oh yeah, next time you are out in the cow pasture, be very careful not to step in the "PELOSI!"

While I disagree with bringing a political comment into this, I am very much in support of the attitude to drop a trailer and go on without fixing it and how you addressed it.
Happened so much to me, I was always being the one delayed to get the load and paying the price of the late load fee.rocknroll nik Thanks this. -
I might be wrong here but the burden of proof is now on YOU to get it FIXED as a driver. The ticket/warning is in your name. YOU need the signature of the mechanic for the fix and to clear your name of this violation. Don't rely on the company for all this to happen because you know the rest of this story.

you have to send it to your company or get the mechanic that fixes it to sign off on it then send it in to your company so they can send it to the dot saying its been fixed.
