1. Attention employers: We now require a valid DOT# for anyone wishing to post a driving position. If your job offer doesn't contain a DOT number, it will not get past moderation and will not appear in the forum. The other requirements in the sticky at the top of this section are still required as well. Thank you for understanding.

Misdemeanors anyone?

My nephew was considering driving team with me, but he told me he has a misdemeanor for aggravated assault. It was minor and is 2 years old. Does he have any chance at all? They mainly ask if you had felonies. Is there a difference to the companies?

It was not violence. A tow truck driving was beginning to tow his car out of his driveway (not allowed to park on street at all) and the tow company routinely takes from drives and if they have the car you have to pay to get it back. All he did was get between the truck and car so he could not drive and threatened the tow driver (Yelling and swearing) because one month earlier his father had his taken from drive and it cost $125.00.
No violence, tow guy never got out of the vehicle. Since tow guy was the one to call cops first, my nephew got the cuffs. $2000.00 for lawyer to no good end. Also, the cops have the tow company under investigation for doing just what they did, but that did not matter. 18 months probation and a misdemeanor record to show for it.

it shouldn't be a problem.......... unless he lies on his application. it is what it is, so, if he is asked, he should offer an explaination and not volunteer info beyond the application.

misdemeanors are usually not too bad as far as employment goes.

The way I understand it there are different classes of misdemeanors, so depending on how its classified. I think they may evaluate it that way.

I think UFO is right on this. And it is going to strictly be up to the company. It might be better if there was a bit more time between applying and the time his probation was completed. But then it may not matter that much.

Again, it is going to be up to the prospective employer. He won't have any problem in getting his CDL with this. I can't answer about the HAZMAT endorsement though. Been out of it too long, and they have changed the rules.

So it would be a good idea to ask someone at your DMV about getting a HAZMAT with this conviction on record. A HAZMAT endorsement is not essential to getting some driving jobs, but to others it is. A lot of companies won't touch you without the endorsement.

I am sorta in the same boat. I have a Brandishing a Firearm in my record (misdermeanor) . Swift trans is looking at me, but until my probation is over..., they can't hire me. So, that is light at the end of the tunnel. I get released from probation next month. Bottom line is don't give up, there are some companies that will at least give you a look.
