What would you have done?

    Unfortunately, that's exactly whats wrong with the DAC system.

    Not only would you fire him, now your going to report on his DAC, in a way that guarantees he cant get a job. Very professional of you. What the guy did was wrong, what you are proposing is even more wrong.

    Why not just report the actual facts, and leave it at that?

    OP, I would have tossed him on his ear. Sounds to me like you didnt ignore his phone calls, and pleas to have to have truck fixed. He just didnt have enough patience to let you handle what needed to be done. 800 miles is a lot of money in fuel, don't blame ya one bit. Don't be shocked if he takes you to court over the fuel money. You have no legal right to with hold that money from him...

    Kansas, You have read more into my post than what was there. I didn't imply that I would lie. If I was his employer I would put in his DAC report that he DH 800 miles home without permission. That would make him unemployable. (Or maybe not depending on the Trucking Company he was applying at)

    Yeah, FIX HIM GOOD right?
    No enough to let him go, deny him income for a long time.....thats the brotherly thing to do.

    What the guy did is not sound business, and obviously immature and irresponsible. The smart thing to do is talk to him, you said he had good hustle.
    Maybe he has potential?
    See if he is:
    1)Sorry for what he did. Genuinely sorry.
    2) Willing to compensate the company for the loss via his income from future work (so you get your money back).
    3) Ready to follow company policy to the letter in order to keep his job/income.

    You already took the loss, nothing you can change that unless he reimburses the company by continuing to drive for you - PROPERLY.
    Hell, after this experience he will either be the best driver he can ever be or he will be out of the business for good - it costs money and time to change drivers/employees/do orientation....etc....

    Another good point.
    He broke his fidelity to the company.
    Did he break his contract? Doe he have one? Does it say, in the contract, that you can cut off his fuel availablilty when he is out of town on company business...for any reason?

    With the right lawyer he will rip you in two, even if he loses he will still cost you many times what the cost of 800 miles of fuel has ALREADY cost you.

    Business is business, dont make it personal. Lawyers get RICH on emotions - I have seen people lose everything they have to keep a lawsuit going that had no chance of providing them ANY relief or monetary recovery - simply because they were mad.

    I'm not going to report on his DAC, but if another company calls for a reference I'll be sure to let them know. This incident happened about 2 weeks ago and was already handled before I ever posted here, I was just curious how others might would have handled it. Also, I told this driver that there was no smoking in our trucks. This truck had never been smoked in and was in perfect condition. Well after he cleaned all his stuff out and left I go to inspect the truck and theres a cigeretteurn hole right in the drivers seat and ashes all over the truck. It just proves this guy didnt care.

    Perhaps by law, only verify employment dates.

    24/7 this driver has called me several times at 3am when his reefer skipped a defrost cycle and he didnt know what to do.

    Deadhead MY truck 800 miles without telling me and I'll give you some progressive discipline!

    Level 1...When you hit the yard I yank you out of the truck!

    Level 2...I'll carry you to the gate!

    Level 3...I'll toss you out onto the sidewalk!

    Level 4...I'll toss all you crap out of the truck out there with you!

    Level 5...I'll deduct the fuel and the money you cost me by deadheading from your check and then you'll owe me money!

    Now...That's progressive discipline!




    ######## like him are the reason that I sold all but one truck!
    Anyone that believes for a second that a driver that does this kind of thing is ever right is a fool.
    Drivers like this are the primary reason that most companies treat drivers like garbage!
    There are far too many of these morons out here.
