Help with defending lawsuit

    Hello. I am defending a trucker in a pedestrian case. He had a 1999 Peterbilt Model 379. The pedestrian walked out in front of him. I need to know the height of the nose of the 379, the length of the hood and the approximate height of the driver's sight line (how high off the ground his eyes were when seated. Our driver is ill, and has sold his truck, so I need help. I tried Peterbilt web site but jsut couldn't find the info I need. Hope someone can help. Thanks a lot!

    I don't have those exact dimensions but I do remember working this out while in training at Arrow. We had a Kenworth t-600 with the sloped hood so we could see objects closer than you could in a 379 with the taller flat hood. The instructor stood in front of the truck with a driver in the seat and moved away until the driver could see him, then we measured the distance. He had to be standing 25 feet in front of the driver's seat to be seen at all.

    Need more info. on his truck. Did it have 22.5 or 24.5 tires? LO pros or standard highth tires. How heavy of a front axle? (12,000, 13,200, 14,600, maby even 16,18 or 20,000) They all sit a little different. How did he usually have the air ride highth set in his seat? how tall is the driver? Is their a bug deflector on the truck? Tire size and front spring rates could change highth by about a foot. A bug deflector about 5 or 6 inches more.
    With out knowing more my guess is just over 6 foot on the low side and up to 7 and a half on the high side.

    I have a 04 379 ext hood
    I will get those for you Thursday
    As I saw posted tire size and at what height did the driver normally ride will make a deference with how close to the end of hood he would be able to see.

    What you should do is go find a truck exactly like that one, whether it's someone's truck or at a dealership. Pay the owner $100 bucks for his time if you have to. Take a good camera, not digital. One of the old 35mm ones so you can blow the photos up big, bright, and clear for the jury to see them. Take your photos around noon to maximize light and minimize glare. Find a guy around the same height as the pedestrian and get photos of the truck with the guy standing in front of it where he said he was, where the driver said he was, and at various distances. Make sure to take them from all angles including from the driver's seat. Then you can have a nice picture show to illustrate exactly what you're describing so the jury can see what you're talking about. If this guy that got hit tries to stretch his story, the pictures will probably show it right there.

    Hell, get a car too. Back the car up 3 feet from the bumper and take photos from inside showing how much of the car can't be seen at that angle. That really is a huge blind spot there.

    One other measurement I am trying to ascertain, height of inflated tire. I have several photos of tractor unit at scene, but none with a person nearby to help with scale. Height of tire will help.

    Dont know actual tire size of "your" truck, but two very common sizes here...
    11R22.5 about 41.3" diameter
    11R24.5 about 44.3" diameter
    lots of variables, tread depth etc, but this will get you close...
