how can HP classify a truck starting on fire a crash?

    You might also add correctional officers (especially juvenile correctional officers)

    and the irony of it was they were ccharged on a technicality, never mind the fact that they did what every other mindful human being would do.

    Hey ya all thanks for the support..Just received another message from HP through DataQ, here is there response.."The question is the preventability of the crash, not that it is a crash. A fire is considered a crash. The preventability question of the crash needs to be submitted to FMCSA with proper documentation." That is word for word folks... So what the hell does that mean??

    So just what is it that could have been done to PREVENT the fire? And I have no idea what that gobbledygook they sent to you means.

    Well our ins. guy seemed to think there wasn't a thing we could have done about it. The guy who did our audit was fantastic believe or not. He agreed we were getting hosed and told me to use his name when trying to get this off our record. A lotta good it did though..

    Sometimes you just have to pay the scum bag, er I mean attorney to take care of crap like this. I know it sucks, but so does having something on your record that just shouldn't be there.

    think we are going to see more and more of this sort of thing as time goes by. The drivers will be spending more time fighting B.S. than driving

    It's not unusual at all. Airline Pilots are the first to come to mind. We're in a position to take life and do much property damage if we have a bad day.

    I believe the main thing drivers need to start doing is to stop looking at driving a semi / big truck from a 4 wheelers perspective and start looking at it more along the lines of say, an airline pilot.

    It's pointless to compare ourselves and the applicable laws to 4 wheelers.
    Example:
    Last week I was east bound on I-94 in MI, cruising along at a comfortable 60mph. I got rear ended by a mentally challenged individual who was also doing the speed limit, but had his cruise on at 70mph. (MI has a split of 10mph). He was distracted and looking off to the side of the road when he smashed my DoT bar into my tire. It wasn't a DoT recordable accident as nobody got hurt and nobody needed a tow truck. I'm almost wishing it was a DoT recordable accident as maybe, just maybe, they'd look at the insanity of the split speed limits. Point is, we're held to higher standards and rightly so. If we had done what this mentally challenged individual did, we'd likely be out of a job at best and in jail at worst.

    So I got no points, no record of the incident and he got off with a ticket. Fair? It doesn't matter. I drive for my livelihood. He drives to collect his SS and unemployment.

    So the question to be asking is, How many other jobs that have a high risk of life and property, do you get fined for if you mess up? all of them.
