I don't think the alcohol level itself is at issue here, although the way it was explained to me is a CDL holder has a limit of .04% whether in a CMV or a personally owned vehicle. I did a quick search and am unable to find the statute number for this. I also understand it that if you are driving a CMV and have any detectable percentage, you can be in some hot water.
That said, if someone is willing to do something as juvenile as go out drinking with no plan as to how they will get home, choose to drive rather than sleep it off in the back seat and then come onto a trucker's forum to whine about it and expect sympathy from some of the professionals that have been doing this for 30 plus years and never gotten that kind of ticket, well, that person has a lot of growing up to do before I would want to trust them with an 80,000 pound projectile aimed at innocent citizens. I'm not saying I have 30 years, but there are many who do.
DWI, DUII, OVI...whatever you want to call it...is not a "mistake." It was a conscious decision on your part to violate a law that even BillyJoeBob under his rock in the far reaches of Alaska knows about. You made that choice and now you are going to have your slick landshark lawyer "get you out of it." I sincerely hope he fails. Just by that statement alone, you have identified yourself as someone who takes no responsibility for your own actions. Get off my roads. There isn't any room for you on them until you have a lot more maturity behind you.

To answer your question, you are not convicted until you go to court.
Any CDL job will ask you if you been convicted of a DUI or similar.
To me you are hanging at the moment. I wouldn't invest in a CDL until you get the charges dropped.
If you get convicted, then it's obvoius you won't drive commercially.
People always deserve second chances. It's what you do with that second chance that counts.
If you really want to drive, do what it takes to get out of those charges. Drinking and drugs don't mix with a truck driving career. So I would say good bye to them too. -
I wouldn't even crawl in the back seat. You can get chaged in some states if you're in the vehicle and have the keys. They say you have control of the vehicle. The best thing to do is have a designated driver or call a cab.

I like my CDL. It took some time and money to get and I don't wish to lose it over something as stupid as drunk driving! I will not consume any adult drinks more than 48 hours before getting in my truck.
