Isnt the new legislation essentially creating a new fleet of drivers whose pay will eventually undercut ours? Isn't that what outsourcing is?

I honestly don't see this as a threat to U.S. drivers...yet. Yes, they will be working for diminished wages, but the amount of freight that they will be taking away from U.S. drivers will be minimal. The companies that do a great deal of hauling in and out of border towns will be affected the most.
All of this hinges on enforcement of cabatoge rules to assure compliance. For sure it willl be tried, and like the Canadian truckers, some will probably get away with a few rogue loads now and then, but those Mexican companies will stand out like a sore thumb and they will be checked.
What these trucks are going to be doing, for the most part, will be serving customers that now are transferring freight through border warehouses. And if there are problems, such as smuggling of drugs or people, or any high profile accidents, etc., it will probably be shut down.
They will still be employees of Mexican based motor carriers, and as such, will not directly be affecting the wages of drivers based in the U.S.
One thing that will come to light in all of this will be to see what effect this has on the perceived "shortage" of drivers that everyone has been touting for years. -
I'm predicting that some trucking companies will use Mexican carriers to take loads destined to the US, from Mexico to their yards and then take a trailer with a load bound for Mexico back as their backhaul. When I worked for Stevens, many of the loads I picked up (or should I say WAITED for) from Laredo were "drop and hook" that I simply took to Dallas because the delivery time hadn't actually been scheduled yet.
Trucking companies with terminals along the border already do this anyways.
