103 Takes a Hit!

    My poor little trucky got punched in the nose one day last week. Parked, and asleep in the bunk I was awakened by a horrible crunch.

    Not really looking like this guy has valid insurance. I will probably end up having to place a claim through my own insurance company, or just pay it out of my own pocket. I don't want to say much else at this point in time, at least till the legalities are sorted out. But, this guy is an O/O leased onto to a medium sized company.

    I would also like to say THANK YOU to any of the half a dozen witnesses who saw it happen, and stuck around long enough to leave me your name and contact info. You guys called BS big time on the guy that hit me when he started trying to make excuses, and tried to dodge out of his responsibilities! YOU GUYS ROCK!!!

    o/o or not, every truck must have insurance. if he's a poor o/o then he needs to be put out of business. i'd still file a claim against him, in fact, since you do have all the information, have your insurance pay for it, then they will go on the attack on him. or even every bit as good, "sic your lawyer on him"....heck, he will even go after the leasing company as well.

    hey, what's right is right, insurance IS required, and he tried taking off you say....???? that IS hit and run, i would believe, so you got him on that as well.

    can't afford insurance...?? then sell the truck and retire.......i feel no sympathy for a hit and run driver.......

    Rerun, thats pretty much the plan currently. Claim it on my insurance, and then have them go after his company. If I just pay out of pocket then NOBODY will do a #### thing about it.

    Apparently when I went inside to grab accident reporting forms, the other driver jumped in his truck and had released his brakes like he was going to leave. One of the witnesses talked him out of leaving lol.

    I got run though the spin cycle with the LEO's on this deal. Called 911, they said since it was private property and no injury they wouldn't come out. Called DOT, they forwarded me to the State Patrol, they sent me to the Sheriff. Sheriff finally got a city cop to come out. City cop said since its private property and no injury he really couldn't do anything. But, he did run the guys CDL and gave me his last known place of residence which it turns out the address I had for him was not valid.

    Not bad mouthing the LEO's in any way shape or form. I know they don't make the laws, they just have to follow them same as I do. Matter of fact, the local officer didnt have to help me one little bit, but he did.

    If he was leased to a carrier they must have liabilty, do all their trucks not have liabilty ins? If so someone needs to know so they can be shut down. Go after the company he is leased to.

    If LEO tell you they won't come because your on private property, just say good, I am going to kill the SOB and hang up. They will show up.

    Sorry to hear about your bad luck but sounds like friends are helping with damage control.

    This must be why I see trucks running around with those defender bumpers....:smt115
    I always thought they were a little over the top.

    sorry about the truck but it's good to see there are still drivers out there that are willing to step up and get involved. Hope things work out for ya.

    Don't companies that lease vehicles have to check and ensure their drivers have insurance and if not, doesn't it default to theirs?

    The motor carrier(lessor) must provide the liabilty insurance. Now if the truck was not loaded it would go to his bobtail ins.(unladen liabilty)

    Yup, Im sure they all do when they first hire on. But, my guess is after that they don't check too awful often. Unfortunately for me this seems to be the case.

    Im stuck with a duct taped front hood until it all gets sorted out:biggrin_25523:

    Second time Ive been hit in a truck stop recently. And I am NEVER the guy on the end. Always tucked in the middle somewhere. I do wonder if one of those big Elk Guards would have saved my butt???
