New York Judge rules 6-year-old can be sued

    Some times parents take no responsibility for their kids. You go to a restaurant and you have these kids misbehaving and making it unpleasant for everyone. Running round shouting bumping in to everyone. I'm not talking about normal kids been kids and not angels. I'm talking about when parents have no regard for anyone by letting their kids run amok. Teaching their kids to lack any form of self discipline or restraint.

    I have no knowledge of this case but there are times when by extension it would be right for parents to be punished. Even if it was an accident as the parents have to exercise judgment and impose boundaries on behalf of their young children. If they negligently allow things detrimental to happen to others , they should not be allowed to hide behind the age of their child.

    If the court is going to be looking in to this to see if this is the case then I agree fully in punishing the negligent parents through extension. The kid however only deserves a reprimand if it was misbehaving and or to apologise if it was an accident.
    A 4 to 6 year old is not mature enough to connect an incident to an action that occur years apart.

    Its no excuse really but I think alot of parents actually fear to discipline their children 'too much' -as defined by "society". What with public schools teaching kids to dial 911 on their parents which always results in a super intense totalitarian "investigation" by the local child services dept and potential arrests even.

    I most definitely don't go for balls to the wall abuse/beatings.. but a firm spank i think in times of complete disregard/disrespect/tantrum is appropriate at times. It instills a healthy 'fear' of a consequence for an inappropriate action that as they get old enough to understand why that action is considered inappropriate the 'punishment' is understood. Discipline CAN be achieved without any physical reprimand I am sure but that takes much more intense care and focus that i think most parents these days find difficult to do what with all the surrounding pressures society\responsibility already thrust upon them.. never-mind the parent that just simply already lets em run amok. -sigh. I never called 911 as a child due to physical discipline and i like to think my manners/respect for others around me are excellent and nor do i suffer any "mental trauma" as a result of said discipline. even tho back then..ha.. a 'normal' spankin was far from what i got.

    most kids these days have no fear or respect for any type of authority wether it is parents/family or teachers or peers. and I firmly believe they learn these 'values' in our public school systems. I dont blame the teachers by any means tho.. they are simply following the mandated criteria. I have dated many a single mom and wow.. i mean just what!! does one do when a 9 or 10 yr old is sittin there straight sayin "NO" and "eff u mom" and "what u gonna do hit me.. go ahead i will call the cops or run away n call the cops" just cuz the lazy kid would rather be glued to his playstation than clean his filthy room or even simply apologize to his sister for hurting her or breaking sumthing even accidently.

    and it definitely doesnt help either when kids can over hear the radio or tv news announcing that its also acceptable/normal/expected for even 6 yr olds to be sued for simple accidents. this is a neverending rant and a neverending debate.. some would debate in agreement and many would debate in disagreement to everythin i said here. idk.

    -just my opinion. take it or leave it. :)

    Can't say I fault your logic on a single point.
    I am not American but have American family and deal with Americans all the time.This My comments were based on how I feel and not on the presiding circumstances. These liberal laws may have good in tensions but have unintended results.We to have these anti spank laws but they are still largely unenforced.

    The courts are so bogged down in frivolous lawsuits it is ridiculous any more. However, I can see the old gal suing the parents for her medical bills. But suing a little kid? That is totally outrageous!

    I'm not sure anyone needs to be "punished" here. However there is no punishment involved in making the parents responsible for the acts of their children.

    Sure, it was probably an accident. But even if it wasn't, if they in their stupid little toddler minds thought it would be funny to run into this old lady, how can you gain anything from suing a kid????????

    What the hell is wrong with this country, where you can't do a little "corporal correction," without going to jail. . .:biggrin_25510:

    As a 4 year old, just learning to ride my bike, I can remember concentrating ONLY on keeping upright...NOT what path I was following, nor the path in FRONT of me...I trusted my parent to tell me to STOP, or SLOW DOWN....or, heaven forbid, THEY had a hand on my bike to stop me, themselves.

    Maybe this childs family should sue the lawyers, and judge, for mental and emotional anguish....on the CHILDS behalf. You know, all those future visits to the head doc for damage done to her by this STOOOOPID lawsuit!!
    Not to mention the fact, that a 4 year old, (now 6) will forever be branded a killer of an elderly person.

    Yet someone like me who had severe Injuires to a knee got the MRI results on my right Knee back last week. They found a 60% tear in the ACl and a 80% tear in the MCL from my fall thru the floor about 2 months ago. However I can not get anyone to go after the idot that owned the trailer they do not see any upside to my case.

    Sounds like a honest workers comp claim there though. Also sounds painful as hell. What is the recovery prognosis?

    Big Don it was at a rental Property that I was in for less than a month. I complained to the park Manager as it was a mopblie home it had weak floors. Then I fell thru. At first the idiot of a maintance man tried to remove me without cutting me out then realized he needed to call for help. It took the Fire Dept close to 30 mins to get me out of there. Needless to say I broke my lease on that place and moved again. As I was moving out I later found out that the trailer in question had been used as a Craack House from 20 people in the park he had also used Fire hoses to clean it out and yet wondered why the floor had weak spots.
