Ive been on here a while doing a lot of reading and have learned a lot. I got laid off as a union electrician last september and got my CDL A in october. I have driven our truck on the farm for the last 5 yrs and in iowa there is exceptions that let u drive without a CDL, but I decided it wouldn't hurt to have the CDL. I do have one question and that is this. We bought a lowboy trailer down in Alabama 800 miles away. We have 2 trucks, one with commercial plates and one with farm special plates. Bad thing is the day cab tractor is the one with commercial plates so were gonna take it down. The daycab is also in better shape and has less miles too. Dad and I both are going and we both have class A CDL's. Bobtailing down and bringing the trailer back. Can this be considered personal use somehow so Ours of Operation can be ignored? Dad doesn't want to stay in a hotel down there. He wants to drive straight down and back and I told him we can't with a daycab "legally". Dad is an old farmer that doesn't care about rules and laws, but I do. What do you guys think?
    Thanks, Lance

You can't log it as team without a sleeper. Welcome to the Forum, and hopefully, someone may have a suggestion or several.

Thats what I was kind of thinking. I read somewhere and I'll try to find it on the DOT site about "personal use" operation. Where hours of operation can be ignored?

    Here is what I found
This is a link to the site http://www.fmcsa.dot.gov/rules-regulations/truck/driver/hos/fmcsa-guide-to-hos.pdf
Personal Use of a Commercial Motor Vehicle
[FONT=LCFFL O+ Times,Times][FONT=LCFFL O+ Times,Times]It is possible that occasionally you may not use a truck in commerce at all. You may be moving your personal belongings to a new house or, as a hobby you may be taking your horses to a horse show. As long as the activity is not in support of a business, you are not operating in commerce.
If you are not operating your truck in commerce, you are not subject to the hours-of-service regulations.

This key phrase to that exception might be where you could run into some problems. You've bought a trailer and are taking it back to your farm for future use in support of the farm, right?

Now, you could probably make it down there and back without crossing any scales. I'm not saying you should do that, but rather making it known that it is possible.

Thanks scarecrow and yes, you are right. Techincally it will be used for business. But who's to say we didn't buy it to haul our "show" truck to shows or something to that effect. Hobby use. It's probably a gray area than can be disputed for ever on here. Thanks again.

This is something that you could probably get by with in all honesty.

The only way I'd see y'all having any problems is if you happen to run across a strict LEO.

800 miles 1 way equates to 1600 miles round trip. That is a long ways to be in a truck, let alone a daycab. Riding or driving.

    Good luck with it, anyway.
