    Thanks for your reply....and I am curious about what a driver has done to end up in prison for a logbook violation. Can you give more details on that?

    Cattle Hauler Fined $12,000 for Falsifying Drivers’ Log Books

    Summary

    Bingham Livestock Transportation, Inc., Tremonton, UT, and owner and President Lorin A. Bingham were sentenced in U.S. District Court in Salt Lake City for falsifying drivers’ log books in a case that has resulted in eight prior convictions since February 2002. The cattle-hauling company was fined $12,000 and placed on probation for 24 months, making it ineligible for government contracts. Lorin Bingham was fined $3,000. The eight earlier convictions, all on hours-of-service charges, included Bingham’s sons and company vice presidents and co-owners, Brad and Barton, and five drivers, two of whom were Bingham’s brothers. The company has a history of hours-of-service violations that FMCSA has cited with warnings and administration fines, which Lorin Bingham has ignored. OIG and the FBI investigated the case, with assistance from FMCSA.

    The Binghams’s challenge to IG criminal investigative authority was dismissed in the U.S. District Court for Utah but has been appealed to the 10th Circuit Court of Appeals and will be argued April 9 in Provo, UT.

    NINE convictions in 12 months! And still no jail time. I'd be curious to learn more about this. It sounds like they should all be convicted of stupidity.

    You should never do anything illegal, whether you are driving a CMV or not. We need a society in which every citizen obeys every rule all the time, no exceptions.

    i suppose a theoritical answer ,would to run loose leaf--keep it current--then keep redoing it backwards to show where you stopped and slept(theoretically slept)
    you can do it that way
    but hey its really not worth it--stop ---sleep--then get home wide awake and alive--rather than driving tired
    trust me--the company wil only cover your back until you get caught
    i used to be the good company boy--run how they wanted me too--try and do my 800 miles or whatever a day without complaint
    now its nice and funny--but i got caught with a bunch of over hours on the 11/14/70---i was to tired to even colour the book right--but thankfully the nice dot man didnt give me a ticket just warnings--but the company got a few
    sure made the safety man stutter and stammer
    its not worth it dude---it could result in jail--or worse yet--you could hurt somebody thru no fault of your own--but you would still be liable

    Here is the deal, run what ever you want, log it as best you can. Make sure your logs match any time stamped and dated materials.

    Too be honest, I have run some runs that may have put me over hours by 1 or 2 hours. It did not take much to figure out how to shave off time in my log book.

    I know it is wrong but sometimes you just can not log it as you go.

    Now if you just want to log it as you go and insist on running over hours, Well that is your choise. Just remember that DOT can stop you and put you in the penalty box for as long as they want. I have seen guys put out of service for 34 hours. Oh and remember that they can put you out of service pretty much anywere they like. As long as there is food and water available IE a vending machine and a water fountain in the reststop. I do nto see that being much fun at all.

    LOL the government loves you.

    jail and fines for a victimless crime? why? society and the government have incurred no loss from log falsification, so why seek retribution?

    this is what's wrong with this country. overzealous control by the government and people like you to support it.

    An old friend of mine has been in prison for about 15 years now, he's serving a 42 year sentence...He was running tired, Very tired and came up on a construction backup and never even hit the brakes.

    He killed 4 and injured 7.

    So....How would you call that a victimless crime?

    His log book looked good at the scene but upon further scrutiny it was found to be a two week long fairy tail.

    Legal is not alway best and it doesn't always make sense, But it's always legal.
    Had my friend been running legal and had he not been pushing it so hard he would have never hit those people.
    Even if he had hit them, If he was running legal he would be a free man today....Broke and unemployed but, free.
