    I was given a speeding ticket in Gauley Bridge WV. The Constitution provides for the town to control speed limits. The Constitution also says I can pay with change “Legal Tender” as described in “The Coinage Act of 1965 Section 31 USC 5103”. When I tried to pay the ticket within the thirty days the town allows, the personnel at town hall refused my payment of legal tender for my debt. I contacted the town prosecutor which is also an assistant county prosecutor about my problem and he said he wasn’t going to do anything about the violation of my Constitutional Rights. Since then I’ve been in contact with numerous State Senators and Delegates, U.S. Senators and Representatives, the W.V. Attorney General, and I’ve also contacted the Governor, and no one seems to want to enforce the U.S. and W.V. Constitutions. U.S. Constitution {Amendment 14 Section 1.} reads “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.” When the W.V. D.M.V. suspended my driving privileges they became complaisant in the violation of my Constitutional Rights. W.V. Constitution {Article 1 Section 3} reads “Any departure or violation of the constitution is subversive to good government.” The preceding article speaks for itself. W.V. Constitution {Article 4 Section 5} reads “Every person elected or appointed to any office takes an oath to uphold the U.S. and W.V. Constitutions.” I take that to mean that the people in the Government that I’ve contacted should take care of this problem. W.V. Constitution {Article 4 Section 6} reads “All officers elected or appointed under this Constitution may, unless in cases herein otherwise provided for, be removed from office for official misconduct, incompetence, neglect of duty, or gross immorality.” I take this to mean that the elected and appointed officials that I’ve contacted and did nothing to take care of my problem are guilty of violating their oath to the Constitutions of the U.S. and W.V. and can be removed from office. It might seem trivial, but our founding fathers thought it was important enough to be part of our Constitutions. I’m wondering why the State [DMV] is willing to help the town violate my constitutional rights which they admit to doing, and no one will do anything about the town breaking the law. Are the laws in WV for everyone or just for certain people? Lately a lot of politicians have been talking about being constitutionally right, well here’s their chance. IN GOD WE TRUST (which is also on the money they refused)

    Could you choose a larger print. The small size is hard to read. To your question, how trivial is it to contact a senator because a clerk in the courthouse don't want to play your game when you drag in two sackfuls of pennies to pay a fine? They recognize ball-busting when they see it and realize perfectly well you had to take the time and effort to go to a bank and buy pennies just for the occaision..right? Let me guess..you're going to reply and say you just happened to have thousands of pennies already laying around at home. Pretty childish actually. I know how pizzed a speeding ticket can make you feel but why play a grade school game with a clerk who had no part in you getting a ticket to start with? You're not punishing the one responsible for you getting a ticket to start with...you. You're trying to punish someone who had no say so whatsoever in what happened to you. Man up, pay it and move on. Just my opinion of course.

    Sounds like someone is bullheaded and vendictive over something that was their fault to begin with.
    We all don't like many laws, but we have to abide by them. Either that or find another country to live in. Stop trying to be a smart ### and pay in normal tender. Pennies are for making change and you know that. First post? Looks like a flame and run to me! :)

    Just shut up, Man up and go pay the fine with regular money like a normal human being.
    Trying to prove a point by paying with small change just makes YOU look like a fool.

    But you're probably used to that by now...

    would you like it if your paycheck was given to you in pennies(wait--depends who drive for--it just might be)
    grow up and pay the ticket-you are just making yourself look childish--if you want to fight it--then fight it

    The government can play games by making you pay a fine for a victimless crime, but how dare you play games back.

    it has nothing to do with punishing a clerk, this town of about 750 people write more tickets than any other town or city in the state. if you check out gauley bridge topix you'll understand the problem. it wasn't all pennies and yes i have thousands of pennies laying around I'm a coin collector. they say there is no such thing as a speedtrap it's the law, well they were put in a constitution trap. If they want to play, play by the law or should the law just be enforced when its benifical for them. so they should man up and obey the constitution which they took an oath to uphold, or is their oath no good

    It does not matter if he pays with pennies or paper bills. The clerk should have taken the payment period.

    If we all could stand up for our rights, trucking would be a much better occupation.
    Good for him I say.

    Having a good bit of change around the house isn't too far fetched. I just rolled over 5100 coins last week. It was in a brass box aprox 5x6x12 inches so it wasn't like a huge amount of space was taken. Ended up with $290.50 rolled, plus an unknown amount that was not enough to complete a full roll. So it seems possible a person would have enough coinage around to pay for a ticket without needing to get more coins from a bank. I wanted an ereader is why I was rolling coins btw.
    I can empathize with the OP. I have been tempted to follow a course similar to what they set upon. However I foresaw difficulties similar to what the OP is going through and decided it was not worth the hassle to prove my point.
    It could be that with the help of an attorney the OP might end up with some satisfaction in the long run. The local government did refuse his legal payment and imposed additional damages to the OP. I image though the cost of following up on this through the courts this will be much higher then the original fine.
    I wish the OP well in his pursuit of satisfaction in this matter.

    Try the ACLU, but they normally only accept cases where the ruling would go against the well being of the country.
