Company says i have to pay for illinois signal light violation of $100 but take $900

    A driver was caught in a photo in Illinois at an intersection where the tail end of his trailer was in the intersection when it turned from yellow to red and a citation was sent to the Trucking company. His trucking company said he could pay it back by taking 3 cents from his mileage until the $100 was paid. They made him sign an agreement but didn't give him a copy. Later he wondered why his paycheck was so low and after three months questioned them about what happened. He asked the office and they said he had to pay back the 30,000 miles for the ticket. The driver said What? What are you talking about. The Chizek office said that until 30,000 miles was paid he wouldn't get his regular mileage amount back. So far this driver has paid $900.00 for a $100 ticket. Isn't this extortion of the driver?

    That is full blown BS! What was the reason why the driver did not get a copy of this "agreement"? The company knew they would be ripping him off. If that document he signed stated that he agreed to accept those terms, I do not know what if any legal recourse is available? Someone may have an idea though.

    It is extortion but the driver let himself get jabbed by not getting a copy of what he signed.......did he even bother to read it....or just take the companies word for what it said......sometimes they will slip a fast one by you like that

    Not extortion; more like theft. If the company took a .03 cent pay cut from the driver to reach that $100.00 fine amount, the driver would have to drive 3335 miles, NOT 30,000 miles! Once he drove those 3335 miles to cover the fine, then they should have bumped his pay back up that .03 cpm. That company is blatantly ripping this driver off.

    Well, having read a hundred of these threads already, I'm working under the assumption that sometimes the story gets garbled in the telling, or some vital facts may have been left out. Not that blatant theft is out of the question.

    Never fall into them finance traps unless it's a $2000 ticket. Simple tickets and they offer to finance, say no thank you, I'll pay it myself. It's stupid to not know what you're signing and not get a copy. As long as there is a signed piece of paper, you don't have a foot to stand on. Now if the paper says $100, then they are stealing your money.

    Request a copy. They can't deny you.

    Sounds like that ticket cost him his 3cent/mile safety bonus, and he has to drive 30,000 dispatched miles before he gets it back.

    A written contract can easily be fought in court (even small claims court) if it falls into unethical practice. Courts will always look at the legal background supporting both parties. If one took advantage of their other because their superior legal knowledge or support team then the courts are likely to side with the little guy. Especially if he was not given a copy and/or recommended to have it reviewed by a legal professional.
